�, � , <br /> � MINUTES OF A COUNCIL MEETING HELD DECEMBER 4 , 1974 Page 36 <br /> � <br /> yHowever, in that area marked as J, there still <br /> is a considerable area of property which had <br /> ` previously been zoned as B-2 but which has been <br /> . always used for residential purposes. The <br /> Council indicated that it is of an utmost <br /> � importance to the preservation of the lake and <br /> to the balancing of the use of the lake for <br /> � commercial and recreational purposes , that this <br /> property be rezoned to a residential zone in order <br /> � to preserve and promote the principles heretofore <br /> stated and in order to protect the residential <br /> � community nearby. Secondarily, this course <br /> • of action will serve an additional public purpose <br /> of maintaining the natural shoreline appearance <br /> � in that area and providing for additional screening <br /> from public view the appearance which attends <br /> � most marina operations. As it concerns specifically <br /> that property noted as J, Mayor Searles noted <br /> � that the Special B-2 Committee Report indicated <br /> that this area should be rezoned from B-2 to a LR-1 C-1 <br /> • 1/2 acre residential zone. By so doing, the <br /> • village would be able to stop the spread of the <br /> marinas and the blight resulting froffr� that <br /> � spread. It was noted that the B-2 areas were <br /> originally zoned to allow for commercial uses <br /> � to provide services for row boats and for the <br /> few motor boats that were present on Lake <br /> � Minnetonka. These zones were created to allow <br /> for small lakeshore resorts and for the rental <br /> � of row boats for fishing. An aerial photograph <br /> • as late as 1945 shows no significant dock <br /> obstruction on Maxwell Bay in the present B-2 zone <br /> � A review of the aerial photo taken in 1971 reveals <br /> that that B-2 zone had proliferated to such a <br /> � point that the original B-2 area was beyond recogni- <br /> tion. It was noted that the original zoning <br /> � ordinance created the B-2 zone for limited <br /> commercial purposes and to allow resorts to <br /> � provide areas where row boats could be rented. <br /> � These uses have been completely subverted to a <br /> point where now the B-2 areas are used for major <br /> � commercial activities with the accompanying <br /> deleterious effect and diminution of values <br /> � to the surrounding residential property. More- <br /> over, many of these B-2 areas have expanded beyond <br /> � the limits allowed in the present ordinance and <br /> have operated for the most part in flagrant <br /> � violation of the village ordinances. It was noted <br /> ! that in addition to the above, at the time of the <br /> adoption of the B-2 zones, the village Council <br /> � and planning commission did not understand the <br /> � <br /> � <br /> � <br /> � <br />
