The City Council finds that the conditions existing on this property are peculiaz <br /> to it and do not apply generaIly to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditians, iight, air <br /> nor pose a fire hazard or other danger to neighboring property, would not <br /> merCly serve as a convenience to thc Owner but are necessary to alleviate a <br /> demonstrable hardship or difficulty; are necessary to preserve a substantial <br /> pmperty right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIUNS,ORDER AND CONDITIONS <br /> Based upon the above findings, the Omno City Council hereby grants a variance to Orona <br /> Mtuiicipal Zoning Code Sectian �8-420(b) to allow a second story addition with a 29.8 foot <br /> front setback �vhen a 50 foot setback is a required, a 22.4 foot setback from the east proprty <br /> line when a 50 foot setback is required and a 23.3 foot setback from the westerly property line <br /> when a 30 foot setback is required,subject to the fotlowing conditions: <br /> , 1. Council appraval is based on the site and hoase plans submitted by the Qwner <br /> and annotated by City staff, attached to this Resolution as Exhibits A. and B. <br /> Any amendments to these plans may require further Planning Commission and <br /> City Council review. <br /> 2. Authorities granted hy this resolution run with the PropeRy not with the <br /> Owner, but aze permissive oniy and must be exercised by obtaining a building <br /> permit for the new construction befare October 22, 20U8 or the variance will <br /> ' expire on that date. <br /> Page 2 of 3 <br />
