A sample <br />agreement is attached. <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use <br />the property in a reasonable manner, and that the criteria for issuance of a CUP <br />are met? <br />2. Does the Planning Commission find that the CUP, if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose additional conditions in order <br />to mitigate any impacts created by the granting of the requested CUP? <br />4. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Planning Staff recommends approval of the CUP for the existing retaining wall as currently <br />located, subject to the property owner entering into an Encroachment Agreement <br />establishing parameters for the continued existence of the wall within the drainage and <br />utility easement. <br />
