� <br /> Unless (�wner and Contractor agree otherwise in writing and so inform Engineer prior to his issuing <br /> � the final Certificate of Substantial Completion,Engineer's aforesaid recommendation will be binding <br /> on Owner and Contractor until�nal payment. Owner shall have the right to exclude Contractor from <br /> the Work after the date of Substantial Completion, but Owner shall allow Contractor reasonable <br /> � access to complete or correct items on the list of items to be completed or corrected. <br /> 9.8 PARTIAL UTILIZATION <br /> � Use by Owner of completed portions of the work may be accomplished pi•ior tc� Substantial <br /> Completion of all the Work subject to the following: <br /> � 9.8.1 Owner at any time may request Contractor in writin to ermit Owner to use a <br /> g p ny part of the <br /> Work which Owner believes to be substantially complete and which may b� so used without <br /> � significant interference with construction of the other parts of the Work. If Contractor agrees, <br /> Contractor will certify to Owner and Engineer that said part of the Work is substantially complete <br /> � and request Engineer to issue a proposed Certificate of Substantial Completion for that part of the <br /> Work. <br /> L 9.8.2 Within a reasonable time thereafter Owner, Contractor and Engineer shall make an it�specti�n <br /> ef that part of the Work to determine its status of completion. If Engineer does not consider that part <br /> of the Work to be substantially complete, Engineer will notify Owner and Contractor in writing <br /> giving his reasons therefor.
