On—site parking variance to Section 38 . 311 (office use) ` <br /> and/or Section 38. 315 (retail use) to allow redevelopment of the ' <br /> property without requiring any on—site parking . <br /> B. The above variances to Sections 35. 041., 35. �42, 35. 046, 38.311 <br /> and 38. 315 are granted subject to all the following conditions: <br /> 1. The above variances are granted to es�tablish guidelines for <br /> maximum authorized development on the property, but this action � <br /> . does not constitute official approval of any actual building <br /> design or site . plan which must be submitted for City Council <br />' review and approval prior to permit issuance in accordance with <br /> • Section 35.�1fd2. <br /> � 2. Subsequent application �for approval of a general office <br />. . buildingincluding spaceforofficesotherthan real estate sales <br /> will require concurrentapplicationfor aconditional use permit <br /> in accordance with Section 35.028 . <br /> � 3. Any �uilding plan submitted for approval shall conform to all� ' <br /> other performance standard requirements for development in the <br /> B—1 zone , including without limitation: <br /> � a) Front yard building setback: minimum 35 feet. <br /> b) Side yard building setback: minimum 15 feet. <br /> c) Maximum building height: 30 feet or 2 1/2 stories . <br />� , d) Rear yard setback per approved variance : minimum 5. 0 <br /> feet. <br /> e�) On—site parking required per approved variance : none; <br /> but if any on—site parking is provided it shall conform to <br /> � the requirements of Section 38. 11�1 et seq. <br /> � f) Al1 applicable state building code requirements. <br /> .. � 4. The maximum building approved by granting of the above <br /> variances shall be an office building of 5100 square feet gross <br /> floor area , which size building requires an allotment of 26 <br /> vehicle parking spaces in the City parking lot. <br />
