Upton is the owner (hereafter "owner") of <br /> a property located at 3685 North Shore Drive within the City of Orono <br /> (hereafter "City") and legally described as Lots 6 and 7, Crystal <br /> Beach; and all of Lot 2, Block l , Crystal Bay View, Hennepin County, � <br /> Minnesota , except that part of said Lot 2 embraced in the plat of <br /> Crystal Beach, (hereafter "the property") ; and <br /> Whereas , the applicant has applied to the City for variances <br /> to Municipal Zoning Code Sections 34. 2P11 , 34. 202 and 34. 552 to permit <br /> new construction within a defined , approved building envelope on a <br /> substandard lot that has an established residence; all new <br /> constructionmaybe placed 50 feet from the lakeshore instead of 75 feet <br /> as required per Section 34. 201 , all new construction may be placed <br /> • within 0 feet of the Hennepin County access road right of way instead of <br /> 30 feet as required per Section 34. 552 and all new construction will be <br /> limited to a 4.7g or 585 square feet increase in hardcover over the <br /> existing 730 square feet within the 0 to 75 feet setback area where none <br /> is allowed per Section 34. 202. <br /> Now, Therefore Be It Resolved by the City Council of Orono , <br /> Minnesota : <br /> Findings <br /> 1 . This application was reviewed as Zoning File No. 777. �-.- <br /> 2. The property is located in the LR-1B Single Family Lakeshore <br /> Residential Zoning. District. <br /> 3. The Orono Planning Commission reviewed this application on <br /> September 19, 1983, and recommended approval of the variance as <br /> proposed based upon the following findings: <br /> a) The approved building envelope for all new construction <br /> meets the intent and objections of the environmental . <br /> standards of' the Comprehensive Plan. <br /> b) The proposed improvements of this property is consistent <br /> with the pattern of improvements on neighboring lots . <br /> � <br />
