The Association, or any insurance trustee sele ted - <br /> by it, sh�ll have exclusive authority to negotiate, settle; and collect upon any c(aims or lo ses , <br /> under an� insurance policy maintained by the Association_ � � <br /> � <br /> . 1 .4 Reauired Policv Provisions. Ait policies of property insurance camed by the <br /> Associat on shall provide, if praciicable,that: <br /> ' 1Q4.1 Each Owner and secured party is an insured Person under ihe policy ith <br /> r�spect to liability arising out of the Owner's interest in the Common Element ar <br /> mlembership in the Association. <br /> 10.4.2 The insurer waives its right to subrogation under the policy against ny <br /> Owner or member of the Owner's household and against the Association and member of I <br /> the Board. <br /> � 10.43 The coverage shap not be voided by or conditioned`upon {i) any ac or <br /> o �ssion of an Owner, unless acting within the scope of authority on behalf of the <br /> A sociation, or (ii) any failure of the Association to comply with any warranty or <br /> condition regarding any portion of the Property over which the Association has no <br /> control. <br /> . 10.4.4 If at the time of a loss under the policy there is other insurance in the n e <br /> o an.Owner covering the same property covered by the policy, the Association's pol'cy <br /> is�rimary. <br /> 10.5 Cancellation; Notice of Loss. All policies of property insurance nd <br /> comprehensive liability insurance maintained by the Association shall provide that the poli ies <br /> shall not be canceled or substantia�ly modified, for any reason, without at least thirty days p 'or <br /> written n�tice to the Association, the insureds, and to all secured parties holding first mortga es <br /> on Units. i <br /> � <br /> 10.6 No Contribution. All policies of insurance maintained by the Association shall be . <br /> the primary insurance where there is other insurance in the name of the Owner covering the sa e � <br /> property, and may not be brought into contribution with any insurance purchased by Owners or <br /> their mortgagees_ , i <br /> l0 7 Owner's Personal ]nsurance. Each Owner shall ob#ain and maintain additio'al <br /> personal i surance coverage (commonly icnown as "ga� coverage"or an "H06"policy) at his or <br /> her own expense covering fire and other casualty to the interior of the Unit,the Owner's perso al <br /> properry and personal liability, and covering insurance deductibles that may be levied by e <br /> Association against the Unit. Insurance policies maintained by Owners are without contributi n <br /> as agaiflst,the insurance purchased by the Association, except as to deductible amounts or ot er <br /> items not �overed under the Association's policies.
