An Owner who causes an alteration to be <br /> made, regaidless of wheiher the alteration is approved by the Board, shall be responsible for the <br /> construction work and any clai�ns, damages, losses, or liabilities arising.out of the alteration. <br /> The Owner, and not the Association, is responsible for determining whether any alteration is in <br /> violation of any restriction imposed by any governmenta] authority having jurisdiction over any <br /> portion of the Property. The Owner shail hold harmfess, indemnify,and defend the Association, <br /> and the Association's officers, directors, committee rnembers, and management agents, from and <br /> against any expenses, claims, damages, losses, or other liabilities, including without limitation <br />. attomeys' fees and costs of litigation, arising out of (i) any alteration which violates any <br /> governmental Iaws, codes, ordinances, or regulations, (ii) the adequacy or inadequacy of the <br /> specifications or standards for constcuction of the alteration, and (iii) the construction of fhe <br /> alteration. <br /> 8.5 Exemntions. The requirements set forth in this Section 8 (except Section 8.4) <br /> shall not apply to the following: <br /> 8_5.1 Construction, reconstruction, or remodeling by Declarant in connection <br /> with its sale of Units. <br /> ' 8.5.2 The installation of the followin� antennas within a Unit or within a <br /> Limited Common Element, as permitted by applicable law: (i) one antenna one meter or <br /> less in diameter .for the purpose of receiving direct broadcast/satellite service or video <br /> programming services, or (ii) any antenna for receiving ielevision broadcast signals. <br /> However, the Board or a committee appointed by it, may require that the antenna be <br /> installed so as to minimize its visibility from the front of the Unit and otherwise <br /> carnouflage its appearance, uniess such requirements would violate applicable law. The <br /> Board shall have authority to impose further, reasonable related requirements consistent <br /> with law. The Owner or Occupant of the Unit shall perform and pay for the installation, <br /> maintenarice, and repair of the installation. . i <br /> � <br /> i <br /> . 8.5.3 Alterations permitted by the Rules and Regulations. <br /> SECTION 4 <br /> MAINTENANCE <br /> 9.l Maintenance by Association. Subject to Seciion 9.2,the Association shall provide <br /> for all maintenance, repair, and replacement (collectively referred to as "maintenance" or <br /> "maintain") of the Common Elements and the Limited Common Blements, in accordance with, <br /> and subject to,the following qualifications: <br /> 9.1.1 The cost of�naintenance of a Limited Common Element required to.be <br /> undertaken by the Association shall be assessed against each Unit to which the Limited <br /> Common Element is allocated.
