.� • � <br /> .' • <br /> individually a "alteration"), including, but not limited to, any structure, building, ' <br /> addition,deck,patio, fence,wall, enclosure, window, exterior door, antenna or other type <br /> of sending or receiving apparatus, sign, flag, display, decoration, color change, <br /> shrubbery,material topographica]or landscaping change,or any other exterior alterations <br /> to or of a Unit oX a Limited Common Element, shail be made, or caused or allowed to be <br /> made,by any O�ner or Occupant,or their invitees, in any part of the Common Elements, <br /> or in any part o#'the Unit which af�'ects the Common Elements or another Unit, or which <br /> is visible from the exterior of the Unit, unless and t�ntil the plans and specifcations <br /> showing the nature, kind, shape, height, calor, materials, and locations of the alterations <br /> shall have been approved in writing by the Board or a committee appoin#ed by it. In <br /> addition, Declarant's written consent sha}l also be required for alterations until Declarant <br /> no longer owns a Unit for initial sate. <br /> 8.1.2 The Board may appoint, supervise, and disestablish an architectural <br /> committee, and speci�cally delegate to it part or all of the functions which the Soard <br /> exercises under this Section 8, in which case the references to the Board shall refer to the <br /> architectural committee where appropriate. The architectural committee shall be subject <br /> to the supervision of the Board. � <br /> . 8.1.3 The Board shal] establish the criteria for approval of alterations, which <br /> shall (i) adequately protect the Property, the Association, and the Owners and Occupants, <br /> : from liability and liens arising out of the proposed atterations or any construction activity <br /> in connection therewith, and (ii) comply with ail governmental laws, codes, and <br /> regulations. The criteria for approva] of alterations shal! include and require, at a <br /> minimum: <br /> 8.1.3.1 substantial uniformity of co[or, location, type, and design in <br /> relation to existing structures and topography, � <br /> 8.t.3.2 comparab]e or better quality of materials as used in existing <br /> improvements on the Property, • • . <br /> 8.1.3.3 ease of maintenance and repair, ; <br /> ; <br /> 8.1.3.4 adequate protection of the Property, the Association, the Owners, <br /> and the 4ccupants from liability and liens arising.out of the proposed alterations, <br /> � 8.13.5 substantial preservation of other Owners' sight lines, if materiai, <br /> and <br /> 8.1.3_6 compliance with govemmental laws,codes,and regulations. <br /> 8.1.4 The Board, or the appointed architectural committee if so authorized by <br /> the Board, in its soie discretion, may impose standards for design, appearance, or <br /> � construction which are greater or more stringent than standards prescribed by the <br /> Governing Documents, or by building, zoning, or other governmental laws, codes, or <br /> . regolations; provided, that such standards shall be consistent with the architectural <br /> character and use of the Property as planned and developed by Declarant.
