<br /> any other restrictions which may be imposed by the Act or the Governing Docume ts, the �
<br /> occu�ancy, use, operation, alienation, and conveyance of the Property shall be subject to the
<br /> following restrictions and conditions:
<br /> 7.1 General. The Property sha}I be owned, conveyed, encumbered, leased, us d, and
<br /> � occu�ied subject te the Governing Documents and the Act, as amended from time to ti. e. All
<br /> covenants, restrictions, and obligations set forth in the Governing Documents are in furt erance
<br /> of a �lan for the Property, and sha[t run with the Property and be a burden and benefi to all
<br /> Owners and Occupants and to any other Person acquiring or owning an interest in the P pert.y,
<br /> their heirs,personal representatives,successors,and assigns.
<br /> ! 7.2 Subdivision or Conversion Prohibited. Except for LJnits subdivided or co verted
<br /> by Declarant pursuant to Section 1b.2, a Unit may not be subdivided or converted by the�Owner
<br /> of th� Unit into two or more Units, Limited Common Elements, Common Elements, or any
<br /> combination thereof. Except as permitted by the Act, no part of the Common Elements ay be
<br /> subd�vided, partitioned, or converted without the prior written approval of all Owne� nd a!1
<br /> secuned parties holding first mortgages on the Units.
<br /> I 7.3 Residential Use. The Units shall be used by Owners and Occupants a d their
<br /> guestis exclusively as private, single family residential dwellings, and not for transient hotei,
<br /> commercial, business,or other non-residential purposes, except as provided in Section 7. . Any
<br /> leasel of a Unit (except for occupancy by guests with the consent of the Owner, and ex ept for
<br /> leasing af Units owed by Declarant) for a period of less than twelve months or any oc pancy
<br /> which includes services customarily furnished to hotel guests, shall be presumed to be for
<br /> transient purposes. . �
<br /> 7.4 Business Use Restricted. No business, trade, occupation, or profession of any
<br /> � kind,l whether carried on for profit or otherwise, shall be conducted, maintained, or pe itted in
<br /> any Unit or the Common Elements,except:
<br /> I 7.4.i An Owner or Occupant residing in a Unit may maintain a home
<br /> occupation in such Unit; provided, that such use (i) is incidental to the residential se;(ii) �
<br /> does nat involve physical alteration or improvement of the Unit visible from the xterior .
<br /> ! of the Unit; (iii) is in compliance with all governmental laws, ordinanc s, and I
<br /> regulations; (iv) does not involve observable bnsiness activity such as signs, adv rtising
<br /> _ ! displays, unusua3 numbers of deliveries, or unusual levels of pedestrian or. v hicular
<br /> i tra�c to and from the Unit; {v) does not involve employees, independent contra tors, or
<br /> ! consultants (other than the Owner or Occupant of the Unit); and (vi) does not ot erwise
<br /> involve activity which disturbs the quiet enjoyment of the Property by other 0 ners ar .
<br /> ' Occupants.
<br /> 7.4.2 Declarant may maintain offces,models,sales facilities,and other usiness
<br /> facilities on the Property in connection with the exercise of its special Declarant ri hts.
<br /> I 7.43 The Association may maintain offices on the Property for man gement
<br /> I and related purposes. .
