<br /> ; ', 12.]3 Restriction on Third Partv Easement Grants. Except for Declarant in the ex rcise
<br /> of its r�ghts under this Declaration, and except for the Board in the exercise of authority anted �
<br /> by th� Governing Documents, no Person shall create, grant, ar convey any easem nt or
<br /> compacabie rights upon any portion of the Property without the prior written approval f the
<br /> Board;i provided, that the Board shatl authori�e an Owner to grant an easement over the 0 er's
<br /> Unit if(i) the easement will not adversely affect the Common Elements ar another Unit d {ii)
<br /> the ea�ement is consistent with the overall design and plan for the Property as establish d by
<br /> Declar$nt and approved by the City. .

<br /> 12.14 Continuation and Scope of Easements. Notwethstanding anything i this �
<br /> . Declar�tion to the contrary, no Owner or Occupant sha11 be denied reasonable access to is or
<br /> her U it or the right to utility services thereto. ,The easements set forth in this Section 12 shall
<br /> supple�nent and not limit any easements described elsewhere in this Declaration or recorde , aRd
<br /> shall ii�clude reasonable access to the easement areas through the Units and the Co mon
<br /> Eleme�ts for purposes of maintenance, repair, replacement, and reconstruction. All eas ment
<br /> rights $hatl include a right of reasonable access to maintain, repair, and replace the utility lines
<br /> and rel�ted equipment.
<br /> , SECTION 13
<br /> I COMPLIANCE AND REMEDIES
<br /> �ach Owner and Occupant, and any other Person owning or acquiring any interest n the
<br /> Prope , shall be governed by and comply with the provisions of the Act, the Gov ing
<br /> Docu ents, and the Rules and Regulations, and such amendments thereto as may be made from �
<br /> time t� time, and the decisions of the Association. A failure to comply shall entitl the �
<br /> Associ�tion to the relief set forth in this Section, in addition to the rights and remedies auth rized
<br /> elsewh�re by the Governing Documents and the Act.
<br /> '13.1 Entitlement to Relie£ The Association may commence legal action to re over
<br /> sums �ue, for damages, for injunctive relief or to foreclose a lien owned by �it, o any
<br /> combir�ation thereof,or an action for any other relief authorized by the Governing Docume ts or
<br /> availab�le at law or in equity. Legal relief may be sought by the Association against any 0 ner, '
<br /> or by $n Owner against the Association or another Owner, to enforce compliance wi the
<br /> Goverrling Documents, the Rules and Regulations, the Act, or the decisions of the Associ tion.
<br /> Howevier,no Owner may withhold any Assessments payable to the Association, or take (or mit}
<br /> other a�tion in violation of the Governing Documents,the Rules and Regulations,or the Ac , as a
<br /> measure to enforce such Owner's position,or for any other reason.
<br /> 13.2 Remedies. In addition to any other remedies or sanctions, expressed or im lied,
<br /> admini trative or legal, the Association shall have the right, but not the obligation, to impl ent
<br /> any on or more of the following actions against Owners and Occupants and/or their guests who
<br /> violate he provisions of the Governing Docuinents,the Rutes and Regulations, or the Act: �
