<br /> 2.2 Encroachments. Each Unit and the Common Elements, and the rights o the �

<br /> Owners and Occupants therein, shall be subject to a nonexclusive easement in favor o the
<br /> adjoini g Units for encroachrnents caused by the construction, reconstruction, repair, shi ing,
<br /> settlem nt, or rttovement of any part of the Property, for improvements which are add d in •
<br /> compli nce with Section 7.13, and nonmaterial inaccuracies in survey. lf there i an
<br /> encroac ment upon another Unit or the Common Elements as a result of any o the
<br /> aforem ntioned causes,an easement shal! exist for the encroachment, for the use,enjoyment and
<br /> habitati n of any encroaching Unit or improvements, and for .the maintenance the eof.
<br /> � Improv ments or alterations added pursuant to Section 7.13 shall be limited to inor
<br /> � encroac ments, and na easement shall exist unless the proposed improvements or altera ions
<br /> have b en approved and constructed as required by this Declaration. Such easements hall
<br /> continu for as long as the encroachment exists and sha{1 not affect the marketability of tit]e.
<br /> 2.3 Sinactural Support Easements. Each Unit and the Cammon Elements sha be
<br /> subject o and be the beneficiary of nonexclusive easements for structural support in all Ifs,
<br /> column , joists, girders, and other structural components located in or passing through an ther
<br /> Unit or ther parts of a Building,or shared with an ad}oining Unit or the Common Elements.
<br /> �,4 Access. Each Unit shall be the beneficiary of a nonexclusive easement for ac ess ,
<br /> to and rom public roadways and walkways on and across those portions of the Com on
<br /> Elemen designated for use as driveways or walkways, as originally constru�ted, shown o the
<br /> Piat, or oiherwise designated by the Association, subject to any restrictions authorized by the �
<br /> Governi g Documents or the Rules and Regulations. The right of access of ihe Owners and
<br /> Occupa ts, and their invitees, to and from the roadway to the west of the Property, comm nly
<br /> known s Cascade Lane, is set forth in that certain Declaration of Easements (Roadway Acc ss)
<br /> recorde in the office of the County Recorder in and for Hennepin County, Minnesota as
<br /> Docume t No. D 75 . That Declaration of Easements also seis forth the obligation o the
<br /> Associa ion to share in the costs of maintaining, repairing, and replacing the portion of Cas ade
<br /> Lane ov r which that right of access is granted.
<br /> � 12.5 Inspection, Maintenance, Repair, Replacement, and Reconstruction. Each nit,
