References to section nurnbers in this Declaration shall <br /> refer to sections of this Declaration,unless otherwise indicated. <br /> SECTION 2 <br /> DESCRIPTION OF UNITS, BOUNDARIES,AND RELATED EASEMENTS <br /> 2.i Units. There are fifty-seven Units, subject to the right of Declarant to subdivide <br /> and canvert Units pursuant to Section 16. A1S Units are restricted exclt�sively to residential use. <br /> Each Unit constitutes a separate parcel of real estate. No portion of a Unit shall be transferred or <br /> I atherwise conveyed apart from any other portions of a Unit. Subject to Declarant's rights <br /> pursuant to Section l6, no additional Units may be created by the subdivision or conversion of <br /> Units pursuant to Section S15B.2-112 of the Act. The Unit identifiers and locations of the Units <br /> are as shown on the Plat, which is incorporated herei❑ by reference. A schedule of the Units is <br /> set forth in Exhibit B attached hereta <br /> 2.2 Unit Boundaries. The boundaries of each Unit shall be the interior unfinished <br /> surfaces of its perimeter walls, floors, and ceilings. Wailpaper, paneling, paint, ceiling texture, <br /> � tiles, floor coverings, and other finishing materials adhered to the interior of the Unit boundaries <br /> shall be a part.of the Unit; provided, that any load bearing portions of any interior or perimeter <br /> walls, columns, ceilings, or floors, and any common utitity lines, pipes, ductwork, mechanical, <br /> electrical, or plumbing systems, or other common facilities serving more than one Unit, but <br /> Iocated in or Qassing thraugh a Unit, shatl be Common Etements. The boundaries of each Unet <br /> shall also extend along t�e inside unfinished surfaces of the Unit's perimeter doors and windows, <br /> and their frames, and said perimeter doors, windows, and frames, and their hardware, sha11 be <br /> deemed to be Limited Common Elements appurtenant to such Unit. Subject to this Section and <br /> Section 3, all spaces,�interior partitions, and other fixtures and improvements within the <br /> boundaries of a Unit are a part of the Unit. <br /> 2.3 Apnurtenant Ea_sements. The Units and the Common Elements shall be subject to <br /> and benefited by the easements described in Section 12. � <br /> SECTION 3 � <br /> � <br /> COMMON ELEMENTS, LIMITED COMMON ELEMENTS, <br /> AND OTHER PROPERTY <br /> 3.1 Common Elements. The Common Elements, and their characteristics are as <br /> - follows: <br /> 3.i.1 Ali of the Property not included within the Units constitutes Common <br /> Eiements. The Common Elements include those parts of the Property designated as <br /> Common Elements in this Declaration, on the Plat, or in the Act; <br /> 3.1.2 The Common Elernents shall be subject to (i) certain easements and <br /> restrictions as described in this Declaration and any other easements recorded against the <br /> Common Elements; (ii) the rights of Owners and Occupants in Limited Common <br /> MPLS-Word 95281.t I 4 ' <br />
