<br /> any other restrictions which may be imposed by the Act or the Governing Documents, the •
<br /> occupancy, use, operation, alienation, and conveyance of the Property shall be subject to the
<br /> foll�wing restrictions and conditions:
<br /> 7.1 General. The Property sha}l be owned, conveyed, encumbered, leased, used, and
<br /> occupied subject to the Governing Documents and the Act,as amended from time to tirne. All
<br /> covenants, restrictions, and obiigations set forth in the voveming Documents are in furtherance
<br /> of a plan for the Properiy, and shatl run with the Property and be a burden and benefit to all
<br /> Owners and Occupants and to any other Person acquiring or owning an interest in the Property,
<br /> their heirs,personal representatives,successors,and assigns.
<br /> 7.2 Subdivision or Conversion Prohibited. Except for Units subdivided or converted
<br /> by Declarant pursuant to Section 16.2, a Unit may not be subdivided or converted by the Owner
<br /> of the Unit into two or more Units, Limited Common Elements, Common Elements, or any
<br /> combination thereof. Except as permitted by the Act, no part of the Common Elements may be
<br /> subdivided, partitioned, or converted without the prior written approval of al] Owners and a!1
<br /> secured parties holding first mortgages on the Units.
<br /> 73 Residential Use. The Units shall be used by Owners and Occupants and their
<br /> guests exclusively as private, single famiiy residential dwellings, and not for transient, hotef,
<br /> commercial, business, or other non-residential purposes, except as provided in Section 7.4. Any
<br /> lease of a Unit (except for occupancy by guests with the consent of the Owner, and except for
<br /> leasing af Units owed by Declarant) for a period of less than twelve months or any occupancy
<br /> which includes services customarily furnished to hotel guests, shall be presumed to be for
<br /> transient purposes. � .
<br /> 7.4 Business Use Restricted. No business, trade, occupation, or profession of any
<br /> kind; whether carried on for profit ot otherwise, shall be conducted, maintained, or permitted in
<br /> any Unit or the Common Elements,except:
<br /> 7.4.1 An Owner or Occupant residing in a Unit may maintain a home
<br /> occupation in such Unit; provided, that such use (i) is incidental to the residential use; (ii) �
<br /> does not involve physical alteration or improvement oFthe Unit visible from the exterior
<br /> of the Unit; (iii) is in compliance with all governmental laws, ordinances, and I
<br /> regulations; (iv) does not involve observable business activity such as signs, advertising
<br />_ displays, unusual numbers of deliveries, or unusual levels of pedestrian or, vehicular
<br /> i traffic to and from the Unit; (v) does not involve employees, independent contractors, or
<br /> consultants (other than the Owner or Occupant of the Unit); and (vi) does not otherwise
<br /> involve activity which disturbs the quiet enjoyment of the Property by other Owners or .
<br /> Occupants.
<br /> 7.4.2 Declarant may maintain offices,models,sales facilities,and other business
<br /> facilities on the Property in connection with the exercise of its special Declarant rights.
<br /> 7.4.3 The Association may maintain offices on the Property for management
<br /> and related purposes. •
