Except for Declarant in the exercise <br /> � of its rights under this Declaration, and except for the Board in the exer�.ise of authority granted � <br /> by the Governin Docurnents, no Person shall create, grant, 4r convey any easement or <br /> comparable right upon any portion of the Property without the priar written approvat of the <br /> Board;provided, hat the Board shal] authQrize an Owner to grant an easement over the Owner's <br /> Unit if(i) the eas ment will not adversely affect the Common Elernents ar another Unit and (ii) <br /> the easement is c nsis#ent with the overall design and plan for the Property as established by <br /> Declarant and ap roved by the City. <br /> 12.14 Ca tinuation and Scope of Easements. Notwithstanding anything in this � <br /> , Declaration to th contrary, no Owner or Occupant sha11 be denied reasonable access ta his or <br /> her Unit or the ri ht to utility services thereto. The easements set forth in this Section 12�sha1! i <br /> supplement and n t limit any easements described elsewhere in tttis Declaration or recorded,and <br /> shall include rea onable access to the easement areas through the Units and the Common <br /> Elements for pu oses of maintenance, repair, replacernent, and reconstruction. All easement <br /> rights shall inclu e a right of reasonable access to maintain, repair, and replace the utility lines <br /> and related equip ent. <br /> S�CTION 13 <br /> COMPLIANCE AND REMEDIES <br /> Each Ow er and Occupant, and any other Person owning or acquiring any interest in the <br /> . Propecty, shali e governed by and comply �vith the provisions of the Act, the Goveming <br /> Documents,and he Rules and Regulations, and such amendments thereto as may be made from <br /> time to time, a d the decisions of the Association_ A failure to comply shall entitle the � <br /> Association to th relief set forth in this Section, in addition to the rights and remedies authorized <br /> elsewhere by the overning Documents and the Act. <br /> 13.1 E titlement to Relief. The Association may commence legal action to recover <br /> sums due, for amages, for injunctive relief or to foreclose a lien owned by �it, or any <br /> combination ther of, or an action for any other retief authorized by the Governing Documents or <br /> available at law r in equity, Legal retief may be sought by the Association against any Owner, ' <br /> or by an Owne against the Association or another Owner, to enforce compliance with the � <br /> Governing Docu ents, the Rules and Regulations, the Act, or the decisions of the Association. <br /> However,no O er may withhold any Assessments payabte to the Association, or take(or omit) <br /> other action in vi lation of the Governing Documents,the Rutes and Regulations,or the Act,as a <br /> measure to enfor e such Owner's position,or for any other reason. <br /> 13.2 R medies.
