� °� <br /> O , O CITY of ORONO <br /> � � � " � RESOLUTION OF THE CITY COUNCIL <br /> �� �`��,` G'�' NO. � � � � <br /> ��kESH��`'� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to Orono <br /> Code Section 78-305(b) in order to construct an enlarged replacement garage with a <br /> basement beneath 35 feet from the front lot line where a 50 foot setback is required, subject <br /> to the conditions listed below: <br /> 1. Council approval is based on the survey and building plans submitted b.y the <br /> Applicant and annotated by City staff, attached to this Resolution as Exhibits A & B. <br /> Any amendments to these plans may require further Planning Commission and City <br /> Council review. � <br /> 2. Prior to the issuance of a building permit for the garage addition the Applicant shall <br /> request a wetland buffer evaluation by the City. The 25-foot wetland buffer shall be <br /> estabfished (or improved) and maintained in the areas shown on Exhibit A. The buffer <br /> work shall be completed prior to the release of the building permit escrow. <br /> 3. Permits from the MCWD may be required. Applicant shall submit copies of MCWD <br /> approvals to the City prior to the issuance of a building permit. <br /> 4. The Applicant shall follow all of the City Engineer's recommendations regarding <br /> grading, wetland buffer requirements and retaining wall construction with the building <br /> permit <br /> 5. The building plans submitted are for the purpose of setback review. The construction <br /> p{ans and survey submitted for building permit will be reviewed for conformance with <br /> Orono's building height and number of stories calculation. <br /> 6. Authorities granted by this resolution run with the Property not with the Applicant, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must <br /> be completed within one year of the date of Council approval, or the variances will <br /> expire on that date (August 13, 2013). <br /> 7. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 8. The undersigned Applicant has read, understood and hereby agrees to the terms of <br /> this resolution and on behalf of their heirs, successors and assigns, hereby agrees to <br /> the recording of this resolution in the chain of title of the Property. <br /> Page 3 of 4 <br />
