Scott and Annette Scott, a married couple, <br /> (hereinafter"Applicant") are the owners of the property located at 19Q5 Heritage Drive within <br /> the City of Orono (hereinafter "City") and legally described as: Lot 3, Block 3, Foxhill, <br /> Hennepin County, Minnesota (hereinafter"the Property"); and <br /> WHEREAS, the Appficant has made application to the City for a variance from <br /> Orono Code Section 78-305(b) in order to construct an enlarged replacement garage with a <br /> basement beneath 35 feet from the front lot line where a 50 foot setback is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on July 18, 2012, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, . <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#12-3564. <br /> 2. The Property is located in the LR-1A zoning district, where 2.0 acres is the <br /> minimum lot area and 200 feet is the minimum defined lot width. The Property <br /> is approximately 1.05 acre in area and has 209 feet in width. <br /> 3. The Planning Commission reviewed this application on July 18, 2012 and on a <br /> vote of 6 - 0 recommended approval of the variances, based on the fbllowing <br /> findings: <br /> a. The lot is provided with Cfty sewer. <br /> b. A Manage 2 wetland exists on the northwest portion of the Property <br /> making it difficult to construct conforming additional garage/storage <br /> space elsewhere. <br /> c.
