;•' . . <br /> maintain and remove all equipment needed for the proper <br /> execution of this contract, and be responsible for the safe, <br /> proper and lawful performance of his men and equipment, <br /> maintenance, and use of the same. <br /> 1.3 All work, equipment, devices and processes shall comply <br /> with applicable building and construction codes, regulatory <br /> measures of any supervisory or regulatory governmental agency <br /> and all work, equipment and materials used shall in addition <br /> conform with requirements of latest edition of all <br /> construction standards as applicable or as incorporated <br /> by reference. Al1 work shall be performed in strict <br /> accordance with manufacturers/suppliers recommended standards <br /> and practices and the quality of workmanship shall be in <br /> keeping with highest standards of the industry. These high <br /> quality industry standards shall govern performance and <br /> execution of work in all sections. <br /> 1.4 The Contractor shall provide and pay for all labor, <br /> materials, permits (including bldg. permit) , licenses, taxes, <br /> equipment, tools, water, heat, utilities, transportation, <br /> & other facilities & services as necessary for the proper <br /> execution & completion of work. <br /> 1.5 The Contractor shall deliver all work free from any and <br /> all mechanics liens, claims or encumbrances of any <br /> description for all labor, equipment, materials and other <br /> items, and shall furnish satisfactory receipts or lien <br /> waivers. Contractor shall agree to indemnify and hold and <br /> protect the Owner and the premises harmless from any <br /> liability or expense by reason of any filed lien or claim. <br /> Refer to Article 9, paragraph 9.12. <br /> 1.6 The Contractor shall warrant and guarantee all materials <br /> and workmanship no less than a period of 12 months from <br /> Owner' s acceptance of the entire construction as evidenced <br /> by an acceptance certificate; except where manufacturers <br /> warranty and guarantee exceeds this time period, then <br /> Contractor' s time length shall be the same. <br /> 1.7 The Owner will furnish construction financing for the <br /> project. The Contractor shall negotiate with Owner for <br /> the percent of retainage for Contractor labor and material <br /> costs on monthly billings. <br /> 2 <br />
