�°� <br /> 0 0 <br /> C ITY of ORONO <br /> ,� � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY GOUNCII <br /> . ��`�x'EsKog'�G No. 5 � 7 2� <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-1288 AND A CONDITIONAL <br /> USE PERMIT PURSUANT TO MUNICIPAL <br /> ZONING CODE SECTION 78-1286 <br /> FILE NO. 08-3375 <br /> WHEREAS, Michael Drazan and Mary Drazan (husband & wife), <br /> (hereinafter "the Applicants") are the owners of the property located at 3546 Ivy Place <br /> within the City of Orono (hereinafter the"City") and legally described as follows: <br /> Lots 175 and 176, TAYLOR'S SUBDIVISION OF SPRING PARK LOTS, . <br /> Hennepin County, Minnesota(hereinafter the"Property"); and <br /> WHEREAS, the Applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-1288 in order to permit 60f <br /> square feet or 0.8% hardcover consisting entirely of an allowed lake access stair within <br /> the 0-75' zone where 0% is normally allowed and 13.6%previously existed; and <br /> WHEREAS, the Applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-1288 in order to permit 4,665 <br /> s.f. or 29.8°/a hardcover within the 75' — 250' zone where 25% is normally allowed and <br /> 5,376 s.f. or 34.5% currently exists in conjunction with the construction of a new single <br /> family home on the existing lot; and <br /> WHEREAS, the Applicants have made application to the City of Orono <br /> for a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1286 <br /> to allow re-grading of the slope within the 0-75' zone after the removal of wooden <br /> retaining walls, a wooden lake access stair and lakeside deck where a conditional use <br /> permit for any topographic alteration is required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of . <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1.
