MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, March 10, 2008 <br />7:00 o’clock p.m. <br />__________________________________________________________________________________ <br />(8. #08-3343 STRONG ARM CONSTRUCTION SERVICES, LLC, ON BEHALF OF AMIT <br />SELA, 460 EAST LONG LAKE ROAD, Continued) <br /> <br />Betty Hamann, East Long Lake Road, Dan and Greg Hamman, sons of Betty Hamann, and Mr. <br />Thorson, Attorney-at-Law, were present. <br /> <br />Miller noted the applicant is requesting a lot line rearrangement to resolve a situation that was <br />discovered following the purchase of 460 East Long Lake Road by his client. Miller indicated a <br />survey completed after the purchase determined that the presumed lot lines were incorrect and that all <br />parties have agreed to the lot line rearrangement as an amicable solution to the situation. <br /> <br />Miller indicated an issue with drainage was raised, but to his knowledge that has been resolved by the <br />granting of an easement. <br /> <br />Kellogg stated Parcel B could grant a 10-foot wide drainage easement to handle the drainage between <br />the two lots. <br /> <br />Turner illustrated the flow of the drainage between the two lots on the overhead. <br /> <br />Rahn asked whether the 15 percent structural coverage was calculated on the entire lot and not just the <br />dry buildable. <br /> <br />Turner indicated the structural coverage is calculated on the entire lot. <br /> <br />Bremer stated she would be willing to approve the resolution subject to the easement being granted. <br /> <br />Bremer moved, Murphy seconded, to adopt RESOLUTION NO. 5735, a Resolution Approving a <br />Lot Line Rearrangement for Properties Located at 460 and 450 East Long Lake Road, and to <br />adopt RESOLUTION NO. 5734, a Resolution Granting Variances to Municipal Zoning Code <br />Section 78-305, for the property located at 460 East Long Lake Road, subject to the City <br />receiving an easement agreement between the parties granting a 10-foot easement along the <br />property lines to resolve the drainage or revising the drainage plan to include a swale on the <br />southern property. <br /> <br />Thorson asked whether the swale would be centered along the two properties or located entirely on the <br />Sela property. <br /> <br />Kellogg stated he did speak with the surveyor this afternoon and the surveyor indicated he was fairly <br />confident that the grade could be reduced along the south side of the new residence. Kellogg <br />recommended the swale be centered on the two property lines to avoid there being two separate <br />swales. <br /> <br />Thorson noted if the swale is located entirely on the Sela property, some mature trees would likely be <br />lost. <br /> <br />Kellogg stated based on the drainage plan he has reviewed, it is likely the mature trees will be <br />compromised even if the swale is located in the center of the two lots. <br /> <br /> <br /> <br />PAGE 4 of 8 <br />Item #02 - CC Agenda - 03/24/08 <br />Approval of Council Minutes 03/10/08 [Page 4 of 8]
