MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, February 11, 2008 <br />7:00 o’clock p.m. <br />___________________________________________________________________________________ <br />(6. #08-3338 THOMAS AND KATHERINE ZIEGLER, 2264 SHADYWOOD ROAD, <br />Continued) <br /> <br />Murphy indicated if the roof over the deck is removed, it would leave a flat roof in that area, which is <br />not an ideal situation in Minnesota. <br /> <br />Curtis stated the building inspector has indicated the roof could be drained with scuppers. <br /> <br />Ziegler stated scuppers serve as a drain similar to a gutter but are not the most ideal solution. <br /> <br />Bremer moved, Murphy seconded, to direct Staff to draft an approval resolution for Application <br />#08-3338, Thomas and Katherine Ziegler, 2264, Shadywood Road, granting of setback variances <br />and a hardcover variance, and allowing the width of the driveway at 26 feet as reflected on the <br />plans. <br /> <br />Ziegler asked whether they would be allowed to plant some evergreens to help block headlights from <br />Crystal Bay Road. <br /> <br />It was the consensus of the City Council that the applicant could plant some evergreen trees in that area <br />but that he should be aware they may need to be removed at some point in time. <br /> <br />McMillan requested the resolution contain language to the effect that the open second-story porch <br />remain open and not be allowed at some point in the future to be converted into living space. <br /> <br />VOTE: Ayes 5, Nays 0. <br /> <br />7. #08-3341 CITY OF ORONO – AMEND MUNICIPAL CODE: FEES AND ESCROWS – <br />ORDINANCE NO. 42, THIRD SERIES AND RESOLUTION NO. 5723 <br /> <br />McMillan asked whether the $500 allotment in engineering fees is given during the application process <br />and then also at the time the building permit is applied for. <br /> <br />Moorse stated the $500 allotment in engineering fees is only given one time and that any engineering <br />fees in excess of the $500 are paid by the applicant. <br /> <br />McMillan moved, Rahn seconded, to adopt ORDINANCE NO. 42, an Ordinance Amending the <br />Orono Municipal Code by Adding Chapter 75 Entitled “Reimbursement of Development Costs; <br />Escrows.” VOTE: Ayes 5, Nays 0. <br /> <br />Bremer moved, Murphy seconded, to Amend Orono Municipal Code Sections 78-42 and 82-47 <br />Regarding Zoning and Subdivision Application Fees and Expenses and Amending Ordinance No. <br />40, 3rd Series, the 2008 Fee Schedule; and to adopt SUMMARY OF ORDINANCE NO. 42, Third <br />Series. VOTE: Ayes 5, Nays 0. <br /> <br />McMillan moved, Rahn seconded, to adopt RESOLUTION NO. 5723, a Resolution Establishing <br />Policy Regarding Engineering Consultant Costs for Zoning and Permit Applications.
