The peak height of the addition being less than 25 feet above the grade of <br /> Highwood Road adjacent to the property. <br /> i. There will be minimal impact on the view from the lake because the addition <br /> is on the road side of the house with the existing house between it and the <br /> lake. <br /> 5. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission in May of 2008, reports by City <br /> staff, comments by the applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on tl�is property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variance would not adversely affect traffic conditions, li�ht, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely sPrve as a <br /> convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br /> or difficulty; is necessary to preserve a substantial property right of the applicants; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the a�ove findings, the �r�;r.� City r'our:cil hereby grants a <br /> variance to Municipal Zoning Code Section 78-330 to construct an attached garage nine feet <br /> from the northwesterly property line when a 10 foot setback is required; and grants a variance to <br /> Municipal Zoning Code Section 78-1288 allowing 46.1 percent hardcover in the 75 to 250 foot <br /> zone when the normal maximum is 25 percent and 49.3 percent was previously approved to <br /> permit the construction of an attached garage and new driveway; and grants a variance to <br /> Municipal Zonin� Code Section 78-1404 allowing 18.4 percent structural coverage when the <br /> normal maximum is 15 percent to permit the existing detached garage/shed to be replaced by an <br /> attached garage/entry of the same foundation area; and grants a variance to Municipal Zoning <br /> Code Section 78-330 to construct an attached garage with three defined stories when the <br /> maximum is two and a half defined stories, subject to the following conditions: <br /> 1. Council approval is based on the site and building plans submitted by the Owners <br /> and annotated by City staff, attached to this Resolution as Exhibits A and B. Any <br /> amendments to these plans may require further Planning Commission and City <br /> Council review. <br /> Page 3 of 5 <br />
