MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, February 13, 2012 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br /> Page 14 of 22 <br /> <br />(9. #12-3540 CHARLES TRUWIT AND PAULA PICARD, 1105 FERNDALE ROAD WEST, <br />Continued) <br /> <br />Truwit pointed out the location of the conservatory on the overheard. <br /> <br />Franchot indicated he is in agreement with Council Member Rahn and Mayor McMillan as it relates to <br />the driveway and that he can live with the conservatory. <br /> <br />Rahna moved, Franchot seconded, Application #12-3540, Charles Truwit and Paula Picard, 1105 <br />Ferndale Road West, to direct Staff to draft a resolution approving the lot width and area <br />variances, a 5-foot side yard setback variance, lake setback variances, a hardcover variance not to <br />exceed 32.2 percent, and a conditional use permit, subject to the City Engineer’s recommendations. <br /> <br />McMillan asked whether it would be the green, blue and yellow. <br /> <br />Curtis indicated that is correct. <br /> <br />Truwit stated it would be everything but the red. <br /> <br />Bremer noted a revised plan and certificate of survey must be provided prior to the resolution being <br />approved by the Council. <br /> <br />Truwit stated he has discussed that with Staff and that he was waiting until the driveway issue was <br />resolved. <br /> <br />VOTE: Ayes 5, Nays 0. <br /> <br />10. #12-3541 KC CHERMAK ON BEHALF OF ROBB AND TINA RICHTER – 3508 IVY <br />PLACE – VARIANCES – RESOLUTION NO. 6112 <br /> <br />KC Chermak, applicant, was present. <br /> <br />Curtis stated the applicant is proposing to redevelop the subject property and construct a new residence. <br />They are requesting a lot width variance, a lot area variance, hardcover variances, as well as a side street <br />setback variance. Due to the topography and shape of the lot, the majority of the driveway for the <br />existing home is located in the right-of-way along with some other encroachments. <br /> <br />The applicants’ proposal includes a setback variance from the right-of-way to allow a 10-foot setback <br />where a 15-foot setback is required; an average lakeshore setback variance to allow a small portion of the <br />covered porch to partially encroach two to three feet; and a hardcover variance to allow 46 percent <br />hardcover. All of the encroaching improvements within the right-of-way are proposed to be removed and <br />the right-of-way will be restored with vegetation. <br /> <br />The Planning Commission voted 5-0 to recommend approval of the request. Staff also recommends <br />approval of the variances. <br /> <br />Curtis noted this application has received supporting comments from the neighbor to the north, who <br />would be affected by the average lakeshore setback variance. Public Works has also commented today on <br />the applicant’s right-of-way vegetation plan and they are satisfied with the proposed improvements.
