� o� <br /> 0 0 <br /> �����t.- � C ITY of ORONO <br /> a :;; � <br /> �',� "'' ���` G'�' RESOLUTION OF THE CITY COUNCI� <br /> ��kESH�4� NO. 5 � � � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> NOW, THEREFORE, BE IT RESOL�'ED, that based upon one or mol-e of the <br /> findiilg� noted above, the City Council of tl�e City of Orono hereby grants Preliminaly.Plat <br /> Approval for Kevin and Denise Reilly, for a 2-lot plat per the Preliminary Plat surveyidrawing <br /> by Marlc S. Gronberg of Gronber� & Associates, Inc. dated 10/24/07 and attached hereto as <br /> Exhibit A, subject to the following conditions: <br /> 1. Conservation Easements for the protection of steep slopes, woodlands, and open spaces <br /> shall be established over tl�e rear portions of Lot 1 and Lot ? (extent to be deteimined) to <br /> be shown on a Conservation/Preseivation Plan drawin�. <br /> Developer shall subinit proposed Conservation Easement lan�uage for Council review <br /> and acceptance, specifyin� the pi-oposed conditions and limitations to be placed on the <br /> specific areas noted above. The easement shall incorporate as a ininimum, the followin� <br /> elements: no structures allowed, no fences, no domestic animals (i.e. no horses, sheep, <br /> chickens, etc.), no tree or vegetation removal except by special permit for maintenanee or <br /> as pari of an approved vegetation mana�emellt plan, no excavating or earth movement; <br /> creation and n�aintenance of non-l�ardcover wallcin� paths may be allowed. Permanent <br /> mar-ke.-s of a desi�;rn and �natel-ial acceptable to tl�e Plaiuling and Zoning Coordinator shall <br /> be placed at all points wl�ere the Consei-��ation Easement intersects a lot boundary or <br /> where tl�e Easement boundary line cl�an�es direction. <br /> 2. Limitations on Indi,-idual Lots. Consezti�ation areas within indi��idual lots sl�all be <br /> sui-��eved ar�d located on a plat drawin� to be filed ii� the chain of t�tle of eacil pr��perty <br /> with a covenant specifically providing ;or the p�-es�:�vation of these areas. <br /> 3.
