Aurpc►se. 'fhe purpc�se of this aetion item is to create Section 14-142 to pr�vide for welihead <br /> protection by prohibiting new private wells where p�blic water supply is available. <br /> 2. Background. ln Uctober of 2013 the City adopted our Wellhead Protection Plan (WHPP). 'The <br /> WHPP is a requirement of the Minnesota Department of Health under Minnesota State Statutes ]031 sub5 <br /> parts 4720.5100-4720.5590. Wellhead Protection is a method of preventing contamination of a public <br /> water supply well by effectively managing potential contaminant sources in the area which contributes <br /> water to a public water supply weil. Pruposed Ordinance. <br /> 14-142 Wellhead Protection-New Private Wells Prohibited. <br /> (A) The owners af all buildings where a public water supply is available,or becomes available,shall connect <br /> the buildings to the public water supply,subject to the following conditions: <br /> 1. A private property with a functioning well will not be required to be connected to the city water unti]the <br /> well becomes nonfunctioning or the building undergoes major remodeling resulting in an increase in water <br /> use that exceeds the capacity of the well. <br /> 2. Where it is not feasible to connect to a public water supply,or if�rivate on-site water supplementation is <br /> required as determined by the City of Orono,a well may be drilled in accordance with the specifications and <br /> provisions of the Minnesota Department of Health, Water Well Construction Code. <br /> (B) At the time connection to the public water supply is completed,all existing private wells no longer in use <br /> shall be sealed by a licensed well contractor according to the Rules of ihe Minnesota Deparnnent of Health. <br /> 4. Justification. Prohibits new private wells from being installed where a public water supply service is <br /> available.This reduces the likely hood that private wells will introduce or draw contaminants into the <br /> City drinking water supply management area. <br /> 5. Recommendation. f recommend adoption of the proposed ordinance as part of our overall well head <br /> protection plan. <br /> COUNCIL ACTION REQUESTED: <br /> Adopt the new Wellhead Protection Ordinance. <br />
