4. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting approval of revisions to the site plan previously approved for variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code�nd Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDTTiONS Based upon one or more of tl�t; above findings, the Orc�o City Council hereby grants a revision to the site plan approved via Resoiution No. b407 in order t0 allow replacement of the pre-existing block retaining wa11s along Crystal Bay Road with boulder�vvalls, all of which will be less than 4 feet in height; and t4 a11ow re-orientation of the approved parking stall to be parallel to Crystal Bay Road rather °Ghhan �etpendicular ta i�, such stall to be approximately 24 feet in width and 7-10' deep, in the location of the existing driveway and slightly west of it; and to allow reconfiguration of the front walkvvay and�; all subje�i to the following conditions: 1. Council approt�a� is based vn the revis�site plan survey submitted by the Applicants and annotated by eity staff, attached to thi� Resolution as Ezhibit A, Any amendments to the revised site plan whic�i are not in co�ormity with City codes will require further Planning Commission�d City C�ncil review. 2. Appiicants shall obtain a separate buii+ding permit for construction of the boulder walls priar to commencem�nt of c;onstruction. 3. Under the revised site plan, Comlition 4 of Resolution No. 6407 requiring a fence or other positive safety barriers shall be placed above the retaining walls that surround the lower parkit�area, is no lt�ger required. 4. All other conditions of Resolution No. 6407 shall remain in full force and effect. 5. Authorities granted by #his resolution run with the property not with the Applicants, but are permissive only and must be exercised by obtaining a land alteration permit for the boulder wall system within one year of the date of Council approval, or the approvals granted herein will expire on that date (February 9, 2016).
