Edwards �j Public Works Director/ Title Public Works Director City Engineer's Report Item Description: Wellhead Protection Ordinance Exhibits A- Proposed Wellhead Protection Ordinance B- Summary of Proposed Wellhead Protection Ordinance l. Purpose. The purpose of this action item is to create Section 14-142 to provide for wellhead protection by prohibiting new private wells where public water supply is available. 2. Background. In October of 2013 the City adopted our Wellhead Protection Plan(WHPP). The WHPP is a requirement of the Minnesota Department of Health under Minnesota State Statutes 103I sub5 parts 4720.5100-4720.5590. Wellhead Protection is a method of preventing contamination of a public water supply well by effectively managing potential contaminant sources in the area which contributes water to a public water supply well. Measure B3-2 of the WHPP plan reads: The City Council will pass and ordinance requiring hookup to City water where available. This will reduce the likely hood that pumping of other wells will dmpact contaminant movement to the City wells. 3. Proposed Ordinance. 14-142 Wellhead Protection-New Private Wells Prohibited. (A) The owners of all buildings where a public water supply is available,or becomes available, shall connect the buildings to the public water supply,subject to the following conditions: 1. A private property with a functioning well will not be required to be connected to the city water until the well becomes nonfunctioning or the building undergoes major remodeling resulting in an increase in water use that exceeds the capacity of the well. 2. Where it is not feasible to connect to a public water supply,or if private on-site water supplementation is required as determined by the City of Orono, a well may be drilled in accordance with the specifications and provisions of the Minnesota Depardnent of Health, Water Well Construction Code. (B) At the time connection to the public water supply is completed, all existing private wells no longer in use shall be sealed by a licensed well contractor according to the Rules of the Minnesota Department of Health. 4. Justification. Prohibits new private wells from being installed where a public water supply service is available. This reduces the likely hood that private wells will introduce or draw contaminants into the City drinking water supply management area. 5. Recommendation. I recommend adoption of the proposed ordinance as part of our overall well head protection plan. COUNCIL ACTION REQUESTED: Adopt the new Wellhead Protection Ordinance.
