ORDINANCE NOMBER 39 , SECOND SERIES <br /> AN INTERIM ORDINANCE ALLOWING EMERGENCY <br /> RESTORATION FROM STORM DAMAGE COMMENCING <br /> JULY 27, 1987 THROIIGH AUGQST 31, 1987 <br /> The City Council of Orono Ordains as follows : <br /> The municipal code of the City of Orono is amended by adding <br /> Ord inance Number 39 , Second Ser ies: <br /> SECTION l. STATEMENT OF POLICY. The City Council shall waive <br /> certain standards of Section 10.03 Subdivision 19 and Section 10.22 <br /> Subdivision 2 in order to allow emergency restoration of lakeshore and non- <br /> lakeshore yards damaged by the severe storms that entered the City on July <br /> 23 , 1987 and July 26, 1987. Staff is hereby directed to issue general <br /> permits for land alterations based on the following guidelines: <br /> a. Filling and grading in excess of 100 cubic yards to permit <br /> restoration to original grades when feasible. <br /> b. Filling and grading within 75 feet of the shoreline of all <br /> lakes to permit restoration to original grades, such restoration <br /> may require installation of retaining walls , the City Engineer <br /> shall rev iew all permits seeking use of retaining wal ls. <br /> SECTION 2. This ordinance shall not be interpreted to include the <br /> restoration of structures damaged by these storms and located within 0 to <br /> 75 feet of the shoreline of all lakes , except for docks that shall be <br /> rebuilt per current standards of the Lake Minnetonka Conservation District. <br /> SECTION 3. The City shall waive the payment of fees for all <br /> general permits that inv olve land alterations under this ordinance. <br /> SECTION 4. A public hearing has been scheduled before the <br /> Planning Commission on September 8, 1987 to review a proposed permanent <br /> ordinance that would establish guidelines and procedures for the City to <br /> follow in cases of natural disasters. <br /> SECTION 5. This ordinance shall be effective beginning July 27, <br /> 1987 and shall terminate on August 31, 1987. <br /> SECTION 6. This Ordinance shall be published in the Laker and <br /> Pioneer newspapers and shall be effective immediately upon publication. <br /> Adopted by the City Council of the City of Orono on the 27th day <br /> of July, 1987 by a v ote of 5 ayes and p nays. <br /> � — -- - --- --- ----- -- <br /> ATTE T: Jam s R.
