•^ � ,, ~ � <br /> G. By making , issuing , or uttering any false or <br /> forged prescription. <br /> Subd. 6. Confiscation and Disposition of Controlled <br /> Substances. Any controlled substance found in the possession^of <br /> any person convicted of a violation of this ordinance shall be <br /> confiscated and shall be forfeited to the Chief of Police who <br /> shall make proper and timely disposition thereof by destroying <br /> it. <br /> Subd . 7. Use of Original Containers and Labels <br /> Re�uired. All patients having possession of any controlled <br /> substance, by lawful prescription of practitioner while such <br /> controlled substance is lawfully in such person's possession, <br /> shall keep such controlled substance in the original container in <br /> which it was delivered until used in accordance with such <br /> prescription, and shall not remove the pharmacist's original <br /> label identifying the prescription from such original container. <br /> Subd. 8. Possession of Injection Im�lement. No person <br /> except dealers in surgical instruments, apothecaries, physicians, <br /> dentists, veterinarians , nurses , attendants , and interns of <br /> hospitals, sanitoriums or any other institution in which persons <br /> are treated for disability or disease, shall at any time have or <br /> possess any hypodermic syringe or needle or any instrument <br /> adapted for the use of cocaine or narcotic drugs or any <br /> controlled substance defined in Minnesota Statutes 152.f�2, or as <br /> defined in Title 21 United States Code 812 by subcutaneous <br /> injections and which is possessed that purpose, unless such <br /> possession be authorized by the certificate of a physician issued <br /> within a period of one year prior to any time of such possession. <br /> Subd. 9. Penalty. Pursuant to these ordinances , any <br /> violation of this ord ni ance shall be a misdemeanor, except that <br /> any first violation for possession of small amount of marijuana <br /> as that term is defined in MN State Statute Section 152.02, Subd. <br /> 16, not including possession in a motor vehicle, shall be a petty <br /> misdemeanor. <br /> Effective Date. This ordinance becomes effective from <br /> and after its passage and publication. <br /> Adopted by the Council this llth day of Mav . <br /> 1987. <br /> Jam R.
