SEC. 4.16. PROHIBITED ACTS BY A LICENSEE (GENERAL) . <br /> Subd. 1. Consumption. It is unlawful for any person to <br /> consume on an on-sale 1 icense premise, or any 1 icensee to permit <br /> consumption of , non-intoxicating malt liquor , wine, or liquor on <br /> licensed premises more than twenty (20) minutes after the hour when <br /> a sale thereof can legally be made. <br /> Subd. 2. Removal of Containers. It is unlawful for any <br /> on-sale licensee to permit any glass, bottle or other container, <br /> containing non-intoxicating malt liquor , wine or liquor in any <br /> quantity, to remain upon any table, bar, stool or other place where <br /> customers are served, more than twenty (20) minutes after the hour <br /> when a sale thereof can legally be made. <br /> Subd. 3. Closing. It is unlawful for any person, other <br /> than an on-sale licensee's bona fide employee actually engaged in <br /> the performance of his duties , to be on premises licensed under <br /> this Chapter more than thirty (3�) minutes after the legal time for <br /> making licensed sales. Provided, however, that this Subdivision <br /> shall not apply to licensees, employees of licensees and patrons on <br /> licensed premises for the sole purpose of preparing , serving or <br /> consuming food or beverages other than non-intoxicating malt <br /> liquor, wine or liquor. <br /> Subd. 4. Conduct on Licensed Premises. Except as <br /> herein provided, every licensee under this Chapter shall be <br /> responsible for the conduct of his place of business and shall <br /> maintain conditions of sobriety and order therein. <br /> Subd . 5. Sale by Employee. Any sale of non- <br /> intoxicating malt liquor, wine or liquor in or from any premises <br /> licensed under this Chapter by any employee authorized to make such <br /> sale in or from such place is the act of the employer as well as of <br /> the person actually making the sale; and every such employer is <br /> liable for all of the penalties provided by law for such sale <br /> equally with the person actually making the sale. <br /> Subd. 6. Manufactures or Wholesalers Interest in Retail <br /> Establishments. No manufacturer or wholesaler shall either <br /> directly or indirectly own or control or have a financial interest <br /> in any retail business . <br /> Subd. 7. No liquor in licensed restaurants. No person <br /> shall consume or carry any intoxicating or non-intoxicating liguor <br /> to or into any restaurant with the purpose of consumption therein. <br /> A. Illegal to permit mixing. No person shall mix <br /> or sell for the purpose of mixing any non-intoxicating malt liuqor, <br /> soft drink, wine, liquor or beverage in a food establishment unless I <br /> licensed as a bottle club. <br /> Subd. 8. Display. It is prohibited that any alcohol be <br /> displayed to the public in any manner in an on or off-sale licensed <br /> operation during the hours in which consumption is not permitted . <br /> 74 <br />
