MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, February 23, 2015 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 3 of 19 <br /> <br />PUBLIC COMMENTS (continued) <br /> <br />Anderst stated in his view it does not make sense that someone should be penalized for owning a piece of <br />property simply because the City does not have records. <br /> <br />Council Member Cornick asked if the Metropolitan Council has said what they will do once they receive <br />the letter. <br /> <br />Anderst stated they have not and that he is merely asked for an affidavit stating what was in there. <br /> <br />Levang asked if there is any other documentation that the book contains or that the author might have. <br /> <br />Anderst indicated he just has what is in the book. <br /> <br />Levang stated the author may have information her files that would be helpful and that he may want to <br />consider getting in touch with her. <br /> <br />Anderst stated the book has dates and pictures. Anderst stated at that time everybody was required to <br />hook up to the sewer line. <br /> <br />Walsh asked if the City has any issues with why they should not do something like that. <br /> <br />Gaffron stated he does not see any issues with it but that he is not sure what value it would have. <br /> <br />Loftus stated the City typically will verify something based on their records but that they could perhaps <br />phrase the affidavit very generically. <br /> <br />McMillan asked if the Metropolitan Council is saying that because this is a bar and restaurant that he is <br />incurring more SAC charges than a beauty salon. <br /> <br />Anderst stated he did not understand it to be that way either but that he needs to prove there were a hair <br />salon and a laundromat in the building, both of which used water. <br /> <br />Gaffron requested Mr. Anderst contact him this week in order to put something together. <br /> <br />PLANNING DEPARTMENT REPORT <br /> <br />3. #15-3707 – AMEND SECTION 78-1405(a)(5) CLARIFY RETAINING WALL AND <br />LANDSCAPE STRUCTURE SETBACKS – ORDINANCE NO. 139 <br /> <br />Gaffron stated the City Council reviewed a brief draft ordinance at their February 9, 2015 meeting and <br />had a number of questions that have been addressed on Page 2 of Staff’s memorandum. Gaffron stated <br />the questions primarily related to the level of construction of low retaining walls or planter beds and <br />whether a person should be required to obtain a building permit. <br />
