� <br /> F � • <br /> � O� <br /> O O <br /> ��b� - CITY of ORONO <br /> � � � <br /> �� G'�' RESOLUTION OF THE CITY COUNCI� <br /> ' ��kESH�4'� NO. � 9 � � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 10.22, SUBDIVISIONS 1 AND 2, <br /> 10.55, SUBDIVISION 8, AND <br /> 10.56, SUBDIVISION 16 (C & L) <br /> FILE NO. 2300 <br /> WHEREAS, James and Joann Jundt (hereinafter "the applicants") are the owners <br /> of the property located at 1400 Bracketts Point Road within the City of Orono (hereinafter "the <br /> City") and legally described as follows: <br /> (Exhibit A attached); and <br /> WHEREAS, the applicants have applied to the City for renewal of variances to <br /> Mi.u�icipal Zoning Code Sections 10.22, Subdivisions 1 and 2, 10.55, Subdivision 8 and 10.56, <br /> Subdivision 16 (C & L) to permit the restoration of an existing retaining wall, underground <br /> grotto and lakeshore stairway system located within the 0-75' lakeshore setback zone where no <br /> hardcover or structure is normally allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2300. <br /> 2. The property is located in the LR-lA Single Family Lakeshore Residential <br /> Zoning District. <br /> 3. The Orono Planning Commission originally reviewed this variance request on <br /> September 16, 1996 and recommended approval of the proposed variances to <br /> restore the lakeshore stairway system, retaining wall and underground grotto, <br /> based upon the following findings: <br /> Page 1 of 6 <br />
