MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Tuesday,May 28,2013 <br /> 7:00 o'clock p.m. <br /> (4. #13-3601 CITY OF ORONO— WETLANDS—ZONING ORDINANCE AMENDMENT, <br /> Continued) <br /> Struve stated his conversation with Bowser was not in regard to the 3-year versus the 5-year but rather a <br /> perpetual delineation. Bowser was saying that the development on Willow View was a residential <br /> development and that they had set wetland boundaries when it was constructed. The Watershed District <br /> was saying that those wetland boundaries should be held forever even though they obviously have <br /> changed. The buffer is now in a wet area. <br /> Struve stated the question asked of Bowser was whether they agreed with the Watershed District and they <br /> indicated they did not. Struve stated in that situation,you would need to do a delineation because <br /> wetlands do change over the years. The Minnehaha Creek Watershed District stated they were really <br /> talking about the buffer area and not the wetland boundary. Struve indicated he was clarifying the <br /> Watershed District's stance on where the wetland edges would be. <br /> Gaffron indicated it changed from three years to five years approximately two years ago. <br /> Struve noted it was changed in 2009. <br /> McMillan asked if that is in the City's new code. <br /> Gaffron indicated it is part of the WACA rules. Gaffron noted the City of Orono would not accept a 10- <br /> year old delineation. <br /> Gaffron stated the City Council can either adopt the ordinance or table the application until a decision is <br /> made by the Minnehaha Creek Watershed District. <br /> McMillan indicated she does not want to go past the June 10`�'meeting. <br /> Anderson moved,Printup seconded,to adopt ORDINANCE NO. 103,Third Series,an Ordinance <br /> Amending Sections 78-1601,78-1605,78-1606,78-1607, 78-1608,78-1610,78-1611,and 78-1612 of <br /> the Orono City Zoning Code Regarding Wetland Protection. <br /> McMillan noted the City Council did not really make any changes to the ordinance amendment tonight. <br /> Gaffron requested the motion also include adoption of the summary ordinance. <br /> Anderson amended her motion,Printup seconded,to adopt ORDINANCE NO. 103,Third Series, <br /> an Ordinance Amending Sections 78-1601,78-1605,78-1606,78-1607, 78-1608,78-1610,78-1611, <br /> and 78-1612 of the Orono City Zoning Code Regarding Wetland Protection,and to adopt <br /> SUMMARY ORDINANCE NO. 104,Third Series. <br /> McMillan indicated she is in favor of the ordinance amendment and that it should hopefully clarify a lot <br /> of things for the applicants. <br /> Bremer stated if the City receives some feedback from the Minnehaha Creek Watershed District that they <br /> are imposing something other than what is anticipated by Staff, she would request Staff advise the City <br /> Council of that. <br /> Page 13 of 18 <br />
