FILE#13-3600 ' ` <br /> 2 April 2013 <br /> Page 2 of 6 <br /> (3J Grading,filling or excavating of ten cubic yards or less within the shore setback zone of <br /> all lakes enumerated in article IX of this chapter. <br /> Sec. 78-1279. -Placement of structures on lots. <br /> When more than one setback applies to a site,structures and facilities must be located to meet <br /> al!setbacks. Structures shall be located as follows: <br /> (6) Average lakeshore setback. No principal or accessory srructure shall be located closer <br /> to the lakeshore than the average distance from the shoreline of existing residence <br /> buildings on adjacent lots; except that this does not apply to stairways, lifts, landings <br /> and lockboxes. Further, the average lakeshore setback shall apply only to classified <br /> lakes and shall not apply to tributaries. The average lakeshore setback line shall be a <br /> straight line connecting the most lakeward protrusions of the residence bui/dings on <br /> the immediately adjacent lakeshore lots. <br /> a. Plat Map <br /> Background <br /> The existing home on the subject property is situated up to 70 feet into the average lakeshore <br /> setback and 25 feet into the required 75-foot setback from the lake. The applicants are <br /> proposing to construct a new residence which will meet the 75-foot lake setback but is <br /> proposed to encroach up to 30 feet into the average lakeshore setback on the northeast portion <br /> of the home. A conditional use permit (CUP) is also requested as the applicant is proposing to <br /> conduct filling and grading activities within the 75-foot setback.
