" <br />ORONO CITY COUNCIL MEETING <br />MINUTES FOR OCTOBER 28, 1996 <br />• <br />( #2. - Preliminary Layout County Road 6 Reconstruction Continued) <br />Hurr asked who pays for the additional cost of an urban section bike path. Polaczyk <br />stated that would be shared 50150 between the County and the city. <br />Goetten asked about the safety of a bike path in an 8' shoulder. Polaczyk stated it <br />certainly is not as safe as an off -road trail, however, shoulder paths work well for <br />bicyclists. <br />Jabbour asked if the residents preferred a cul -de -sac or a loop road. They indicated a <br />cul -de -sac. <br />Callahan asked for a show of hands regarding the bike trail. There was a split <br />preference of those in the audience. <br />Callahan moved, Jabbour seconded to adopt Resolution #3783 approving the preliminary <br />layout for County Road 6 as presented, and Council will discuss the bike trail at the joint <br />Council /Planning /Park Commission work session Wednesday, October 30. Vote: Ayes <br />5, nays 0. <br />Robert Hanning, 4220 Sixth Avenue North, questioned the Council regarding receiving • <br />just compensation for property that is taken for the reconstruction. Theis stated he had <br />a handout regarding compensation. Polaczyk stated the County hires an appraiser who <br />places a value on the property to be acquired. The County right -of -way people will <br />make an offer to the property owner based on the appraisal. If you take exception to that <br />you can hire an appraiser, which you will be compensated for up to $500.00, but that <br />compensation will not be given back to you until the final settlement is reached. If there <br />is still no settlement then the property would go into condemnation and would be heard <br />by a Condemnation Committee. The Committee would hear both sides and they would <br />make a determination of the value. <br />City Attorney Radio stated the District Court Judge appoints the 3 member <br />Condemnation Committee. Generally the members are an attorney who is familiar with <br />condemnation, a real estate appraiser and a real estate broker. Throughout the process <br />there is very little for the city to do. The matter is between the property owner and the <br />County. If you are not satisfied with the Condemnation Committee determination you <br />can go to District Court for a jury trial. <br />( *4.) APPROVAL OF MINUTES <br />Jabbour moved, Goetten seconded to approve the Consent Agenda as amended. Vote: <br />Ayes 4, Nays 0. <br />• <br />4 <br />
