� o� <br /> 0 0 <br /> �'�.�°_.�:, _,,, CITY of ORONO <br /> � :�. � <br /> �� � `�� G~' RESOLUTION OF THE CITY COUNCIL <br /> L�kES8�4� NO. �> f-� � � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findin�s, the Orono City Council hereby �rants a <br /> variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of an <br /> addition to the existing home 11 feet ahead of the average lakeshore setback line, subject to the <br /> following conditions: <br /> l. Council approval is based on the survey and building plans submitted by the Applicant <br /> and annotated by City staff, attached to this Resolution as Exhibits A R. B. Anv <br /> amendments to the site plan which are not in conformity with City codes will requir� <br /> further Plannin� Commission and City Council review. <br /> 2. Proposed hardcover levels are conforming and no hardcover variances are �ranted. <br /> 3. The building plans submitted for building permit will be reviewed to ensure compliance <br /> with the City's buildin�hei�ht and number of stories re�ulations. <br /> 4. Authorities granted by this resolution run with the property not with the Applicant, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing consh-uction of said project. A framin� inspection must be <br /> completed within one year of the date of Council approval, or the variance will expire on <br /> that date (Au�ust 22, 2012). <br /> �. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 6. The undersigned Applicant has read, understands and hereby agrees to the terms of this <br /> resolution and on behalf of the Applicant and the Applicant's heirs, successors and <br /> assin s, hereby agrees to the recording of this resolution in the chain of title of the <br /> Property. <br /> Adopted by the Orono City Council on the 22"d day of Au�-ust, 2011. <br /> Page 3 of 4 <br />
