Outside of the 75-foot setback from Lake Minnetonka a property owner <br /> can apply for and get a staff-issued permit to move 0 to 500 cubic yards. More than 500 cubic yards <br /> requires a Conditional Use Permit which must be approved by the City Council. Within 75 feet of the <br /> lake a property owner may get a staff-issued permit to disturb, move, fill, etc up to 10 cubic yards; more <br /> than that requires a CUP from the City Council. There should always be erosion control materials <br /> (fencing, bio-logs, etc) protecting the site if there is potential for storm water to run sediment off site. <br /> Lastly, after further review of the approved variance, since a pool permit was issued and work has <br /> begun, a building permit for the cabana can be applied for without renewing the variance.
