The proposed pool and its location are not out of character for the immediate <br /> neighborhood. Both adjacent neighbors have pools located Uet�veen the lake <br /> and home. <br /> . d. A hardcover variance is not requested. <br /> e. The pool will meet all other zoning district standards. Although the adjacent <br /> neighbor to the west has objected to the location of the pool near the property <br /> boundary, the pool will not reduce existing lake views enjoyed by that <br /> neighbor, and hence the intent and oUjectives of the average lalceshore setbacic <br /> ordinance are still met if the variance is granted. <br /> f. The applicants have proposed a landscape plan to mitigate the impacts of the <br /> pool on the adjacent wetland and on the lake. The proposal is attached as <br /> Exhibit B. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Plaiuling Commission, reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply �enerally to other property in this zoning district; that granting <br /> �iic^ Vu.1S..C� �✓Ci.�u^C� u'�V;:SS�� wff��rt trµfj;C �pnriltinric� lial�t� air nnr pncP � _fi_re <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to �reserve a substantial prcperty right of the <br /> applicants; and would be in keepin� with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan oFthe City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based tipon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-1279 Subdivision 6 to allow a pool to be <br /> constnicted lake�vard of the average lakeshore setback, subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and annotated by <br /> City staff, attached to this Resolution as Exhibit A.
