y • <br /> � <br /> � ��{ �S'��'�"� C�i�� �� ��o�� <br /> �a� <br /> ll � <br /> °n.��; F� ,-.�{^�- <br /> �{��u ��� RESOLUTION OF THE CITY COUNCIL <br /> ���.�. . <br /> �- �: <br /> �a- NO. 2901 <br /> � -�a� .� <br /> A RESOLUTION GRANTING <br /> A CONDITIONAL USE PERMIT <br /> PER MUNICIPAL ZONING CODE <br /> SECTION 10.03, SUBDIVISION 19 <br /> FILE #1591 <br /> WHEREAS, Orville Fisher (hereinafter "the applicant") <br /> is the owner of the property located at 3300 Fox Street within <br /> the City of Orono (hereinafter "City" ) and legally described as <br /> follows : <br /> Tract A, Registered Land Survey #727, Files of Registrar of <br /> Titles, County of Hennepin. <br /> Tracts C and D, Registered Land Survey #1358 , Files of <br /> Registrar of Titles , County of Hennepin (hereinafter <br /> "property") ; and <br /> WHEREAS, the applicant has applied to the City of Orono <br /> for a conditional use permit to permit land alterations <br /> involving more than 100 cubic yards of material and outside the <br /> normal scope of a new residence building permit, pursuant to <br /> Municipal Zoning Code Section 10.03, Subdivision 19. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #1591. <br /> 2 . The property is located in the LR-lA Lakeshore <br /> Residential Zoning District. <br /> 3. On November 19 , 1990 , the Orono Planning Commission <br /> reviewed the application as proposed and recommended <br /> approval on a vote of 6-0, finding that the proposed grading <br /> work is generally necessary for the redirection of drainage <br /> and protection of the mound sewage treatment system. <br /> Redirection of the drainage will tend to reduce the impact <br /> on neighboring properties of additional run-off created by <br /> the new residence. <br /> 4 . The City Council has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by staff and comments of the applicant <br /> and the effect of the proposed use on the health, safety, <br /> and we 1 f are of the community. <br /> Page 1 of 4 <br />
