The City Council finds that the proposed location of the conditional use is in accord with the objectives the purposes of the RR-1B zoning district in which the site is located and with the comprehensive municipal plan and that the proposed land alteration would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a conditional use permit far a land alteration permit to create an area for construction of a sport court, subject to the following conditions: � 1. Council approval is based on the grading plan submitted by the owners and annotated by City staff, attached to this Resolution as Exhibit A. Any changes or amendments to this plan will require further Planning Commission and City Council review. 2. Authorities granted by this resolution run with the property not with the owners, but are permissive only and must be exercised by obtaining a land alteration permit before June 9, 2008 or grounds will exist for revocation of the conditional use permit. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically � terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Owners have read, understand, and hereby agree �o the terms of this resolution and on behalf of the owners and the owners' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
