- _ � °� <br /> 0 0 <br /> ' �� CITY of ORONO <br /> a� ;- <br /> ,r,� ;�,,_ ,'� <br /> �� ��� �'�' RESOLUTION OF THE CITY COUNCIL <br /> L�kES�I��'� NO. � � � � <br /> A RESOLUTION GRANTING <br /> A CONDITIONAL USE PERMIT <br /> FOR LAND ALTERATION <br /> PER SECTION 78-966 <br /> FILE NO. 08-3359 <br /> WHEREAS, David C. Weyerhaeuser and Elizabeth Weyerhaeuser, husband <br /> and wife, (hereinafter "the Owners") are the owners of the property located at 1540 Fox Street <br /> within the City of Orono (hereinafter the "City") and legally described as: <br /> See Exhibit A.; and <br /> WHEREAS, the Herb Baldwin has made application on behalf of the Owners <br /> to the City of Orono far a conditional use permit for land alteration to create a level area for a <br /> sport court; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on May 19, 2008, at which time all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS - <br /> 1. This application was reviewed as Zoning File#08-3359. <br /> 2. The City Engineer has reviewed the plan and finds it acceptable. <br /> 3. The Planning Commission reviewed this application on May 19, 2008 and on a <br /> vote of 5 - 0 recommended approval of the conditional use permit. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the owners and the public, and the effect of the proposed <br /> conditional use on neighboring properties and the community. <br /> Page 1 of 3 <br />
