MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, September 12, 2016 <br />7:00 o'clock p.m. <br />16. #15-3763116-3860 CHRISTOPHER BOLLIS, 200-250 STUBBS BAY ROAD NORTH — <br />FINAL PLAT REVIEW (continued) <br />McMillan asked whether anyone from the public would like to continent on this application. <br />Tom Fleming, 300 Stubbs Bay Road, stated he believes it makes sense to have the ability to construct <br />homes on the lots but that his concern is if something happens over time and the road is not constructed, <br />whether that will bleed into Lots 4 and 7. Fleming noted there is soil compaction that takes place with <br />road construction and there are mature trees. Fleming stated there has to be some timeline and that it <br />cannot go on forever. FIeming stated he is a little concerned about a secondary access since it is not part <br />of what Orono typically does. FIeming noted the City has very specific ordinances about multiple access <br />points. <br />Fleming indicated he is the third owner on Outlot A and that he does have concerns about how it is <br />plotted. Fleming noted Tamarack Hill will be superseded by Kintyre. Fleming commented he is not sure <br />how the ownership will go as well as the requirements of maintenance. Fleming indicated he would <br />prefer to see the secondary access eliminated since there is a road being built. Fleming stated ultimately <br />he is willing to take responsibility for his portion of the outlot. <br />Walsh noted the City Council really does not have much control over the driveway since both Mr. Bollis <br />and Mr. Fleming own the driveway and that it will need to be an agreement between the two of them. <br />Walsh asked if he would have any problem to allowing them to use the access to construct the homes. <br />Fleming indicated he would not but that he does not want to see it bleed into more homes <br />Gaffron noted the development agreement does not allow a home to be built until there is one lift of <br />asphalt laid. Gaffron stated it is reasonable to use the driveway to construct homes on Lots 5 and 6. <br />McMillan concurred that there needs to be some closure to the road. <br />Walsh commented it might be five years before both homes are constructed and that perhaps there should <br />be a sunset clause on it. <br />Gaffron stated what the City typically requires is that the secondary access be graded out so it is not <br />usable once the two homes are built. <br />Gaffron indicated Staff will bring back the approval resolution at the next Council meeting. <br />The City Council took no formal action on this item. <br />(The City Council took a recess from 8:48 p.m. to 8:53 p.m.) <br />17. LEVEL II HOME OCCUPATION LICENSE, 4415 FOREST LAKE LANDING <br />Barnhart stated the property owners at 4415 Forest Lake Landing would like to use their property for <br />indoor piano concerts for 15 events per year for up to 40 people per event. The patrons would be shuttled <br />to the event using a commercial shuttle. Since the events will go later than 7 p.m., it triggers a Level II <br />home occupation. <br />Page 16 of 34 <br />
