There is concern regarding the creek crossing at the east end of that driveway, which is fairly <br />narrow. <br />d. Any permanent use of that driveway as access suggests that Lots 5 and 6 must be treated as <br />`through' lots, abutting roads at opposite lot boundaries, which affects setback requirements for <br />accessory structures. <br />e. The City Attorney has commented that the driveway access easements and covenants should be <br />reviewed by the applicants. If lots 5 and 6 abandon access to the driveway in favor of the new <br />cul-de-sac, they might still be responsible for maintenance of a driveway they are not using. <br />f. If the driveway is abandoned, it should be revegetated to eliminate unnecessary hardcover. <br />Gaffron stated Staff will bring a final plat resolution in two weeks but would like direction on the three <br />issues noted above. <br />Chris Bollis, 350 Stubbs Bay Road, stated the purpose of the wobble in the road is to preserve additional <br />trees. If the road comes directly off the outlot, 18 trees versus 14 trees will be impacted. The trees in red <br />are the ones that will be saved due to the wobble. <br />Bollis stated when they were Iooking to subdivide the property, they were looking at conservation and <br />preservation, which is what they are attempting to meet. The second benefit of the wobble is that it slows <br />traffic down. <br />Bollis noted they are not asking for the road construction equipment to come up Kintyre Lane and that <br />they want all the traffic to come down the existing gravel driveway. The contractor has said he has no <br />problems with that but that the special paving equipment has to come down Kintyre. As a result of <br />grading the road and putting in cement curb and gutter, there will be a two -foot drop and that the paving <br />equipment cannot go over that drop. Bollis indicated they are talking about one day where the paving <br />equipment will be there. Bollis submitted a letter from the contractor. <br />Walsh noted the first 250 feet will have curb and gutter and the rest will not. Walsh stated in his opinion <br />the road will have an unfinished look to the road. <br />Bollis noted there will be two lifts of asphalt put down and that one will be done this fall and the other <br />will be in the spring. Bollis stated there is a curb and gutter cul-de-sac which that portion of the road will <br />connect to. The curb and gutter allows more trees to be preserved rather than grading out for ditches. <br />Bollis stated there is a natural transition going into it and is also part of the stormwater management plan. <br />Bollis noted it is easier if the runoff is directed towards a filtration area rather than going to one specific <br />point on a curb and gutter road. <br />McMillan commented Orono has always preferred less curb and gutter, but that there are points where the <br />water needs to be channeled a certain direction. <br />Gaffron asked if the bituminous trucks wi1l also be going up and down Kintyre. <br />Page 13 of 34 <br />
