MINUTES OF THE ORONO COUNCIL MEETING OF OCTOBER 10, 1988 <br />ZONING FILE #1333 SIDNEY REBERS CONTINUED <br />allow for more tree preservation. <br />Mr. Rost stated that one of the two major points in favor of <br />the rezoning is the transition that will occur between the <br />commercial and residential zoning. The 1 -acre PRD with the <br />buffer perimeter will lend itself better to abutting commercial <br />property than the 2 -acre rural residential zoning. The other <br />point is that this proposal is consistent with the Highway 12 <br />Corridor, which has served as the underlying, framework for this <br />plan. , <br />Councilmember Callahan asked for clarification as to where <br />the proposed rezoning will occur. Mr. Rost indicated on the <br />sketch where the dividing line between the commercial zoning and <br />the proposed 1 -acre zoning would occur. Callahan stated that he <br />was impressed with the proposal asked whether there were any <br />neighbors present who wished to express their view point. Mr. <br />Robbin Sentell, 736 Dickey Lake Drive, addressed the Council.. He <br />agreed that the development plan was laid out very well. His <br />only concern involved a potential connection of the cul -de -sac <br />with Pine Ridge Lane. Since that was not being proposed, he had <br />no objections to the proposal. Callahan expressed his opinion of <br />having the subdivision and rezoning applications heard <br />simultaneously. <br />• <br />Councilmember Goetten thought that the development was going • <br />to be very attractive and utilized the area quite well. Her <br />concerns involved traffic, Brown Road and a buffer between this <br />development and the property owners to the north. <br />Councilmember Nettles stated that he liked the concept of <br />transition from Highway 12 to this residential development. He <br />questioned where the private road would loop should it be <br />required to do so, or in the alternative, where an emergency <br />vehicle access would be located? Mr. Rost stated that there <br />would be two possible locations for the emergency access. One <br />would be off of Highway 12, the other would be Pine Ridge. <br />Nettles questioned the need for such an access and asked the City <br />Attorney about the City's liability requirements. City Attorney <br />Barrett responded that there has been increased litigation <br />arising with regard to road designs. The zoning ordinances that <br />would control this development, discourage cul -de -sacs. However, <br />a variance would not be required if approval of the cul -de -sac <br />were given. City Administrator Bernhardson added that the issue <br />of the cul -de -sac is one that will be addressed under the <br />guidelines of the subdivision. <br />Councilmember Callahan asked Mr. Pflaum if there was a <br />significant reason why the rezoning needed approval at this <br />meeting, as opposed to waiting until the subdivision was <br />presented for a vote?
