r. .
` MINUTES OF THE
ORONO CITY COUNCIL MEETING
' Monday,February 13,2012
7:00 o'clock p.m.
(9. #12-3540 CHARLES TR UWIT AND PA ULA PICARD, 1105 FERNDALE ROAD WEST,
Continued)
Truwit pointed out the location of the conservatory on the overheard.
Franchot indicated he is in agreement with Council Member Rahn and Mayor McMillan as it relates to
the driveway and that he can live with the conservatory.
Rahna moved,Franchot seconded,Application#12-3540,Charles Truwit and Paula Picard, 1105
Ferndale Road West,to direct Staff to draft a resolution approving the lot width and area
variances,a 5-foot side yard setback variance, lake setback variances,a hardcover variance not to
exceed 32Z percent,and a conditional use permit,subject to the City Engineer's recommendations.
McMillan asked whether it would be the green, blue and yellow.
Curtis indicated that is correct.
Truwit stated it would be everything but the red.
Bremer noted a revised plan and certificate of survey must be provided prior to the resolution being
approved by the Council.
Truwit stated he has discussed that with Staff and that he was waiting until the driveway issue was
resolved.
VOTE: Ayes 5,Nays 0.
10. #12-3541 KC CHERMAK ON BEHALF OF ROBB AND TINA RICHTER—3508 IVY
PLACE—VARIANCES—RESOLUTION NO. 6112
KC Chermak, applicant, was present.
Curtis stated the applicant is proposing to redevelop the subject property and construct a new residence.
They are requesting a lot width variance, a lot area variance, hardcover variances, as well as a side street
setback variance. Due to the topography and shape of the lot,the majority of the driveway for the
existing home is located in the right-of-way along with some other encroachments.
The applicants' proposal includes a setback variance from the right-of-way to allow a 10-foot setback
where a 15-foot setback is required; an average lakeshore setback variance to allow a small portion of the
covered porch to partially encroach two to three feet; and a hardcover variance to allow 46 percent
hardcover. All of the encroaching improvements within the right-of-way are proposed to be removed and
the right-of-way will be restored with vegetation.
The Planning Commission voted 5-0 to recommend approval of the request. Staff also recommends
approval of the variances. '
Curtis noted this application has received supporting comments from the neighbor to the north, who
would be affected by the average lakeshore setback variance. Public Works has also commented today on
the applicant's right-of-way vegetation plan and they are satisfied with the proposed improvements. The
Page 14 of 22
