BACKGROUND. The City is the fee owner of certain property located within the City of <br /> Burnsville, County of Dakota, State of Minnesota legally described as LoT_, B�ocx_, , <br /> having a street address of , (the "subject property"). The City owns the property <br /> for park purposes. The Owner is the fee owner of certain property located within the City of , <br /> County of , State of Minnesota legally described as LoT_,Btocx_, , having <br /> a street address of , (the "benefiting property"). The Owner has constructed a <br /> fence on the subject property. <br /> 2. ENCROACHMENT AUTHORIZATION. The City hereby approves the encroachment <br /> of the existing fence upon its property, subject to the conditions set forth in this Agreement. No additional <br /> structures may be placed upon the subject property without prior written approval by the City. <br /> 3. MAINTENANCE AND REPAIR OF FENCE.
