MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JULY 27, 1987 <br />#1160 WILLARD BURY /DAVID E. LEE <br />2695 CASCO POINT ROAD <br />VARIANCE <br />RESOLUTION #2234 <br />Applicant /Owner Willard Bury and Applicant /Buyer David <br />Lee were present for this matter. <br />City Administrator Bernhardson explained that this <br />matter was tabled at the last Council meeting so that <br />the prospective buyer of the property could be present. <br />Applicant previously submitted three alternatives to <br />reduce hardcover in order to pave driveway. Applicant <br />prefers Alternative 1 resulting in 35.1% 75 -250' <br />hardcover. Staff recommended Alternative 2 resulting in <br />34.0% hardcover. The buyer, Mr. Lee, requests approval <br />of Alternative 4 which consists of Alternative 2 with <br />the deletion of the requirement that 160 s.f. of the <br />parking turn - around area be eliminated, which would <br />result in 35.6% hardcover. <br />David Lee, owner of the David Lee Funeral Home in <br />Wayzata, stated that his business occasionally requires <br />him to drive the limousine home, and more importantly, he <br />would need the extra area for his two teenage <br />daughters to park and exit the driveway safely. He <br />indicated that he could not purchase the home unless <br />Atlernative 4 was approved. <br />Larry and Correnne Kane, 2697 Casco Point Road, were <br />present for this matter. The Kane's were upset about <br />the City allowing the fill to be brought in in order to <br />build the house on the property which has since upset <br />the drainage. They do not understand the reason for a <br />code when the City allows deviations from the code. <br />They stated that during the last rain storm, water from <br />the swale flooded their basement. They indicated that <br />drainage from applicant's driveway was no problem. <br />Councilmember Goetten stated that applicant's driveway <br />was very narrow and felt there was a legitimate safety <br />concern. She suggest staff work on solving the drainage <br />problem. Therefore, for health, safety and welfare <br />purposes, she would approve Alternative 2, but would not <br />approve any more hardcover being allowed on this <br />property ever. <br />Attorney Blatz noted that the Kane's are currently in <br />litigation with the City regarding the drainage and <br />recommend no further discussion of the drainage problem. <br />Mr. Bury stated that the reason he is withdrawing his <br />previous agreement with the City for driveway strips is <br />for the sole reason of safety. <br />3 <br />
