MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JULY 27, 1987 <br />11136 DICK HASSEL* <br />840 HUNT FARM ROAD <br />FINAL SUBDIVISION <br />RESOLUTION #2230 <br />It was moved by Councilmember Sime, seconded by <br />Councilmember Goetten, to adopt Resolution #2230 <br />granting final approval of Huntington Farm Second <br />Addition. Motion, Ayes 5, Nays 0. <br />#1148 ST. EDWARDS EPISCOPAL CHURCH <br />865 NORTH FERNDALE ROAD <br />CONDITIONAL USE PERMIT <br />RESOLUTION #2231 <br />Present representing St. Edwards Episcopal Church was <br />Bill Martin. <br />City Administrator Bernhardson explained the request for <br />a conditonal use permit to allow day care /pre- school <br />instrution by the Wayzata Home Base and Montessori <br />School of Wayzata to be conducted within the lower level <br />of the church building. The original application <br />proposed 45 -50 people (students, teachers, etc) and at <br />that point Appendix E of the Fire Code would apply to <br />this occupancy level requiring a fire suppression <br />system. Subsequent, to that, the proposal has been <br />reduced to a maximum of 29 people which does not require <br />sprinkling of the building. <br />Mayor Grabek was concerned about the liability to the <br />City if the church exceeds the maximum allowed occupancy <br />and a fire occurs, and how will this be monitored. <br />City Administrator Bernhardson noted that there are <br />ground level emergency exits from all classroom areas to <br />be used by both agencies. <br />Zoning Administrator Mabusth stated the Fire Inspector <br />Jacobs and staff intend to conduct two or three <br />unannounced inspections per year. <br />Bill Martin stated that the maximum occupancy will be <br />put in the leases and the church will monitor the use <br />level. <br />Mayor Grabek suggested requiring the City of Wayzata and <br />Long Lake Fire departments to inspect and approve the <br />property. <br />Attorney Blatz, in response to Mayor Grabek's <br />suggestion, noted that as long as the City places <br />conditions in the resolution that meet the code and take <br />some measure to enforce the conditions, the City would <br />not be liable if the conditions were violated. <br />3 <br />
