MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JULY 27, 1987 <br />11128 RAINEY ANDERSON <br />780 OLD CRYSTAL BAY ROAD SOUTH <br />PRELIMINARY SUBDIVISION <br />RESOLUTION <br />Present for this matter were: Rainey Anderson, Surveyor <br />Gary Gabriel, and Attorney Herbert Lefler. <br />City Administrator Bernhardson explained the preliminary <br />subdivision which was revised to include two additional <br />lots, extension of the road portion to be developed, and <br />inclusion of a 50' road outlot to connect to the Kumlin <br />plat at some future time. Planning Commission voted 3 -2 <br />to recommend approval subject to changing the access <br />location to directly across from Farview Lane. The <br />majority vote of the Planning Commission felt that from <br />a planning perspective, the access across from Farview <br />Lane is more appropriate even though the proposed access <br />over the existing driveway entrance does meet minimum <br />safety standards. The minority vote did not feel it was <br />appropriate to disallow an access that meets the safety <br />standards, concurring with the opinions expressed by the <br />City Attorney and City Engineer. <br />Assistant Zoning Administrator Gaffron stated that the <br />disadvantages to applicant in changing the access <br />location is more road cost and less desireable lots. <br />Councilmember Goetten questioned the status of Mr. <br />Kumlin's concern of his subdivision having a substandard, <br />lot if the road outlot was required. <br />Assistant Zoning Administrator Gaffron stated that the <br />entire 50' corridor was taken from the Rainey Anderson <br />subdivison, however, Mr. Kumlin is still not agreeable <br />to this corridor because he feels it will lower the <br />value of his property in addition to the potential of <br />road surrounding two sides of Lot 3. <br />Herbert Lefler stated applicant requests the Council pay <br />particular attention to the fact that the proposed <br />access meets the minimum access standards. <br />It was moved by Mayor Grabek, seconded by Councilmember <br />Sime, to conceptually approve the preliminary subdivison <br />per the findings and conditions of the preliminary draft <br />resolution and the location of the private road access <br />onto Old Crystal Bay R,-.)ad South shall be as proposed by <br />the applicant at the existing driveway entrance serving <br />the existing residence.
