MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JULY 13, 1987 <br />#1157 BRAKE CONTINUED <br />Councilmember Callahan questioned staff's recommendation <br />for approval because it is "consistent" with previous <br />approvals on lakeshore properties. <br />Mayor Grabek agreed with Councilmember Callahan feeling <br />that the terminology ( "consistent ") used by staff may <br />place the City in a bad position with future <br />applications. <br />Assistant Zoning Administrator Gaffron explained the <br />reason behind the statement was to stress to the Council <br />that the hardship reasonings have been consistent. <br />City Attorney Blatz explained the need to be consistent <br />with similar hardships. <br />Councilmember Callahan questioned staff recommendation <br />of approval when the memo states that the applicants <br />have demonstrated no hardship to justify the variance, <br />but the variance would be consistent with previous <br />variance approvals. <br />Assistant Zoning Administrator Gaffron explained that in <br />reviewing the history of hardships used in approved <br />variances, that this may be a long standing problem with <br />the City's policies, and in fact may not be as much a <br />hardship as the statute mandates. <br />It was moved by <br />Sime, to adopt <br />plan per staff <br />Councilmember <br />satisfied with <br />#1159 FRANKLIN GROVES JR. <br />215 HOLLANDER ROAD <br />CONDITIONAL USE PERMIT <br />RESOLUTION #2218 <br />Mayor Grabek, seconded by Councilmember <br />Resolution #2217 approving the revised <br />recommendation. Motion, Ayes 4, Nays 1. <br />Callahan voted nay stating he was not <br />the drafted resolution. <br />City Administrator Bernhardson explained the request for <br />a conditional use permit for regrading yard area - <br />importation of 500 -1,000 cubic yards of fill. City <br />Engineer Cook has reviewed and approved the grading plan <br />feeling it would have minimal effect on the drainage in <br />the area. <br />Present representing Mr. Groves was his accountant. He <br />stated Mr. Groves has reviewed and approved staff's <br />resolution. <br />14 <br />
