MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JULY 13, 1987 #1157 BRAKE CONTINUED Councilmember Callahan questioned staff's recommendation for approval because it is "consistent" with previous approvals on lakeshore properties. Mayor Grabek agreed with Councilmember Callahan feeling that the terminology ( "consistent ") used by staff may place the City in a bad position with future applications. Assistant Zoning Administrator Gaffron explained the reason behind the statement was to stress to the Council that the hardship reasonings have been consistent. City Attorney Blatz explained the need to be consistent with similar hardships. Councilmember Callahan questioned staff recommendation of approval when the memo states that the applicants have demonstrated no hardship to justify the variance, but the variance would be consistent with previous variance approvals. Assistant Zoning Administrator Gaffron explained that in reviewing the history of hardships used in approved variances, that this may be a long standing problem with the City's policies, and in fact may not be as much a hardship as the statute mandates. It was moved by Sime, to adopt plan per staff Councilmember satisfied with #1159 FRANKLIN GROVES JR. 215 HOLLANDER ROAD CONDITIONAL USE PERMIT RESOLUTION #2218 Mayor Grabek, seconded by Councilmember Resolution #2217 approving the revised recommendation. Motion, Ayes 4, Nays 1. Callahan voted nay stating he was not the drafted resolution. City Administrator Bernhardson explained the request for a conditional use permit for regrading yard area - importation of 500 -1,000 cubic yards of fill. City Engineer Cook has reviewed and approved the grading plan feeling it would have minimal effect on the drainage in the area. Present representing Mr. Groves was his accountant. He stated Mr. Groves has reviewed and approved staff's resolution. 14
